    Facts of the Crime:

    Sanborn was originally tried and found guilty of capital murder on March 8, 1984. The court imposed the death sentence on March 16, 1984. The Kentucky Supreme Court’s reversal of Sanborn’s conviction in June 1988 resulted in a new trial in October 1989. Sanborn was again found guilty of murder, kidnapping, rape and sodomy in a retrial in Louisville, Kentucky and sentenced to death on May 14, 1991 in Henry County. The victim, Barbara Heilman, a Henry County woman, was killed on October 12, 1983.

    In today's orders, the Sixth Circuit Court of Appeals REVERSED the judgment of the district court insofar as it granted habeas relief to Parramore Sanborn. AFFIRMED the judgment of the district court in all other respects. Accordingly, REMANDED these causes to the district court with instructions to deny Sanborn’s petition for a writ of habeas corpus.

    Sanborn death sentence reinstated

    A federal appeals court has reinstated the death penalty for a Kentucky man.

    The Court of Appeals reversed a lower court decision that would have given Parramore Sanborn a new sentence for a 1983 kidnapping, rape and murder in Henry County.

    The court concluded there was no legal violation when a psychiatrist questioned Sanborn in 1991 about his defense.

    Sanborn was examined because he claimed extreme emotional distress during the murder.

    I find it absolutely mindboggling that Judge Merritt was one of the Judges on the panel that reinstated Mr. Sanborn's death sentence. Judge Merritt has been notorious for overturning death penalty sentences at such a high rate.

    In today's United States Supreme Court orders, Sanborn's petition for a writ of certiorari and motion for leave to proceed in forma pauperis was DENIED.

    Condemned Inmates Pursuing Funds For Clemency Bids

    Two Kentucky death row inmates are hoping that brain scans and mental tests will bolster their cases for a rare grant of executive clemency that would spare their lives.

    Ralph S. Baze Jr., condemned for killing a sheriff and deputy in eastern Kentucky in 1992, has asked a federal judge to grant him funding for testing as he prepares a petition for Gov. Steve Beshear.

    Baze's request, filed Wednesday in federal court, comes just more than two weeks after U.S. District Judge Jennifer Coffman in Louisville granted $7,500 to Parramore Lee Sanborn to pursue a possible claim of brain damage. He was convicted in 1983 of killing Barbara Heilman in Henry County.

    Governors have granted commutations to only two death row inmates in Kentucky in the last 35 years.
