Roger Lamar Wheeler - Kentucky Death Row

    Facts of the Crime:

In 1997, while on parole for ten counts of Robbery I, Wheeler killed Nigel Malone and Nairobi Warfield. Both of the victims were stabbed multiple times. When detectives arrived at the scene they discovered the murder weapon, a pair of scissors, still in the neck of one of the victims and a blood trail leading from the victims to the streets. Blood samples collected at the scene matched Wheeler's blood.

Pair of executions set for appeals in Kentucky

LOUISVILLE / FRANKFORT, Ky. (AP) -- The Kentucky Supreme Court is set to hear an appeal in the case of an escaped inmate accused of kidnapping a Kentucky worker. While a federal appeals court in Louisville will take up the case of a death row inmate accused of killing two people.

The long-running case of an escaped inmate from an Oklahoma prison facing a death sentence is over the fatal kidnapping of a Kentucky distillery worker.

The Kentucky Supreme Court justices will hear the case of 56-year-old Michael Dale St. Clair on March 13 in Frankfort. St. Clair is appealing the conviction and sentence out of Hardin County in the 1991 kidnapping of Francis "Frank" Brady of Bardstown. Prosecutors say St. Clair and an accomplice snatched Brady from a rest stop along Interstate 65. Brady was later found shot to death in neighboring Bullitt County.

St. Clair has also been sentenced to death in Bullitt County on a charge of murder. The justices heard an appeal in that case in February.

The federal appeals court in Louisville will hear the case of a Kentucky death row inmate convicted of killing two people in Louisville later this year.

The U.S. 6th Circuit Court of Appeals in Cincinnati has set an Oct. 1 hearing date in the case of 53-year-old Roger Lamar Wheeler. Wheeler has been condemned to death for the 1997 slayings of Nigel Malone and Nairobi Warfield.

Police say Wheeler was on parole for 10 counts of robbery when the slayings happened.

Police say Malone and Warfield were stabbed multiple times with a pair of scissors and the first detectives on the scene found a blood trail leading from the pair to the street.

Detectives say blood samples collected at the scene matched Wheeler.

On February 20, 2015, the US Court of Appeals for the Sixth Circuit REVERSED Wheeler's death sentence and REMANDED the case with instructions to issue a writ of habeas corpus. The vote was two to one, with Judges Merritt (Carter) and White (Clinton/G.W. Bush) in the majority and Griffin (G.W. Bush) dissenting.

    SCOTUS reverses 6th Circuit

SCOTUS reversed the 6th's ruling today. Says juror was NOT improperly dismissed.

And gave them a final smack at the end of the ruling:

"As a final matter, this Court again advises the Court of Appeals that the provisions of AEDPA apply with full force even when reviewing a conviction and sentence imposing the death penalty. See, e.g., Parker v. Matthews, 567 U. S. ___ (2012) (per curiam); Bobby v. Dixon, 565 U. S. ___ (2011) (per curiam); Bobby v. Mitts, 563 U. S. 395 (2011) (per curiam); Bobby v. Van Hook, 558 U. S. 4 (2009) (per curiam).

The petition for certiorari and respondent’s motion to proceed in forma pauperis are granted. The judgment of the Court of Appeals for the Sixth Circuit is reversed, and the case is remanded for further proceedings consistent with this opinion."

Gilbert Merritt's concurrence sounds a lot more like a dissent to me. Figures.
