    Peggy Edenfield sentenced to 60 years in prison in death of Christopher Barrios

    Peggy Edenfield was sentenced to 60 years in prison today after a plea agreement for her role in the 2007 death of 6-year-old Christopher Barrios.

    The state dismissed the two felony murder charges against her as part of the negotiated plea. Edenfield pleaded guilty but mentally retarded to false imprisonment, child molestation, cruelty to children, concealing a death and tampering with evidence. The judge, at the recommendation of the prosecutors sentenced her to the maximum on each charge, which adds to 60 years.

    She is 62.

    After the sentence was announced, Peggy Edenfield’s sister, Sharon Phillips, stood up and shouted that Edenfield’s lawyer, Richard Allen, has only seen her twice in the five years she’s been in prison and accused a Glynn County police officer of spraying Lysol on her sister.

    At that point, Sue Rodriguez, the boy’s grandmother who was sitting across from Phillips in the courtroom, stood up and said, “What about Christopher?”

    Phillips answered, “I’m so sorry about that. Peggy doesn’t even know what an indictment means.”

    Christopher’s father, Mike Barrios, said he didn’t want any kind of plea bargain.

    “I didn’t want no deal. Christopher wouldn’t have wanted that,” he said. “There is no closure, but it will be good to see her die in prison.”

    Rodriguez, Christopher’s paternal grandmother, said she could accept the plea.

    “We wanted Christopher to get his day in court, but he still got it even thought his is a plea deal," she said. "Sixty years; she won’t ever get out. She won’t never do this to another child.”

    The first felony murder count charged her with causing Christopher's death by encouraging or helping her husband, David, and their son, George, sodomize and choke him.

    David Edenfield has been on Georgia's Death Row since shortly after a jury found him guilty of malice murder in October 2009. A convicted child molester, George Edenfield, remains in a state mental hospital undergoing treatment until psychologists determine he is competent to stand trial.

    Of course they are all retarded. You would have to be mentally diminished to sit there and masturbate while your husband and son molest and kill a young boy. What has she done on this earth for the previous 60-something years? lol. I also noticed how they have tried to play the tard'card for every goddamn person in this family. Is this what America has become? Blaming the brutal rape and murder of a child on numerous adults because they are all retarded? What am I thinking....of course that is it.

    This is one of the most disgusting, vile murders I have ever read about. I only mention this on rare occasions. This case screams " BACK WOODS SOUTHERN JUSTICE" There is absolutely not one mitigating factor that could justify such a heinous act!

    Ga. woman tries to withdraw plea in child's death

    A Brunswick woman who pleaded guilty Sept. 1 for her role in the 2007 killing of a 6-year-old boy is seeking to withdraw the plea that sent her to prison for 60 years.

    The Brunswick News reports the woman, Peggy Edenfield, 62, filed a handwritten motion Friday in Glynn County Superior Court.

    On Sept. 1, during what was supposed to be a final hearing before her trial was to begin in Valdosta, Edenfield pleaded guilty but mentally retarded to false imprisonment, child molestation, cruelty to children in the second degree, concealing the death of another and tampering with evidence in the 2007 killing of Christopher Michael Barrios. Glynn County Superior Court Judge Stephen Scarlett sentenced her to 60 years in prison.

    Edenfield had been accused of murder, but that charge was dropped as a result of her plea agreement, because prosecutors said she did not physically kill Christopher.

    Her husband, David Edenfield, 63, was sentenced in 2009 to death for killing and molesting Christopher in the trailer where the Edenfields lived. Their adult son, George Edenfield, 36, was also charged in the killing, and is in a state mental hospital until he is ruled mentally competent to aid in his defense.

    In her motion Friday, Edenfield claimed that her court-appointed lawyer, Richard Allen, did not properly explain to her the consequences of changing her initial plea of not guilty to guilty. Citing her IQ of 62, Edenfield said in the motion she was mentally handicapped and was led to believe she would still have a trial even if she signed the plea agreement.

    The motion says Allen visited Edenfield only twice prior to the Sept. 1 hearing, while she was incarcerated at the Wayne County Jail in Jesup. She also claimed that she could not reach him by telephone.

    Allen insisted he had served Edenfield well.

    "Anyone who would check the jail logs would know that I went to see her well more than two times, especially in the beginning when everything was so important. I saved that woman's life. She would have gotten the death penalty. We turned down a life sentence that would have meant she wouldn't have parole for 30 years. Now she has a parolable case," Allen said.

    Court to hear appeal of conviction in Ga. boy's death

    A Georgia man is appealing the convictions and death penalty he received for the 2007 rape and murder of a 6-year-old boy.

    The state Supreme Court will hear arguments Wednesday in the appeal of David Edenfield. He was convicted in 2009 in the death of Christopher Barrios in a trailer park outside Brunswick.

    Edenfield's lawyers argue the trial court shouldn't have allowed incriminating statements Edenfield made, saying they were improperly obtained. They also say the judge should have declared a mistrial when the prosecutor called Edenfield an "animal" during sentencing.

    Prosecutors argue Edenfield's statements were correctly obtained and note the prosecutor apologized for his "animal" remark, and the judge instructed jurors to disregard it.

    The arguments will be held at the University of Georgia School of Law in Athens.

    Accused child molester, killer George Edenfield to undergo commitment proceedings

    A man accused of murder in the sexual abuse slaying of 6-year-old Christopher Barrios in March 2008 will undergo an independent evaluation to determine if he should be civilly committed to a state mental health facility.

    After the evaluation is complete, George David Edenfield must appear in court April 18 for a trial on his civil commitment, Superior Court Judge Stephen G. Scarlett said in an order signed Tuesday.

    George Edenfield and his parents, David and Peggy Edenfield, were all charged with murder, child molestation, false imprisonment, cruelty to children and other charges in Christopher's death. Evidence at David Edenfield's trial showed that George Edenfield lured Christopher into his family's mobile home off Canal Road north of Brunswick where the father and son molested the boy and strangled him. Days later, Christopher's body was found inside black plastic garbage bags in woods 2 miles from the mobile home park where the Edenfields, Christopher's father and his grandmother had homes.

    On Aug. 4, 2010, Scarlett found George David Edenfield incompetent to stand trial and committed him to the Georgia Department of Health & Developmental Disability for treatment to restore his competency and for further evaluation.

    In January 2011, a state psychologist said Edenfield was still incompetent in understanding the nature of court proceedings and in assisting his attorney but had shown some progress.

    On Feb. 21, the court received a follow-up evaluation in which Karen Bailey-Smith said that Edenfield was still not competent to stand trial, could not be restored to competency in the foreseeable future and that he meets the criteria for inpatient civil commitment.

    District Attorney Jackie Johnson's office says her office believes a more recent evaluation is necessary and asked the court for an independent evaluation by Greg Cox, a licensed clinical psychologist practicing in Brunswick.

    The defense agreed to Cox's appointment.

    David Edenfield was convicted of malice murder and other charges in Christopher's death and is on death row.

    Peggy Edenfield pleaded guilty but mentally retarded to false imprisonment, child molestation, 2nd-degree cruelty to children and other charges and is serving a 60-year sentence.

    Judge asked to commit man charged in boy's killing

    A Georgia man charged with molesting a 6-year-old boy before choking him to death in 2007 should be committed to a state mental hospital, prosecutors and defense attorneys told a judge Thursday after experts testified the suspect would probably never be fit to stand trial.

    George Edenfield, 37, could spend the rest of his life in inpatient treatment at a state hospital if Superior Court Judge Stephen Scarlett gives the order to commit him. The judge asked attorneys Thursday to draft an order for him to sign next week. Once committed, Edenfield would have his case reviewed each year but could only be released by a court.

    Lawyers on both sides agreed with two psychologists that six years of treatment has failed to make Edenfield competent to stand trial for murder, child molestation and other crimes in the March 2007 slaying of Christopher Michael Barrios, a Brunswick kindergartener. Prosecutors who once intended to seek the death penalty conceded it's now unlikely that he will ever face a jury.

    "The state has pushed its case as far as we can. We obviously wanted to go to trial," District Attorney Jackie Johnson said after the hearing. "Based on six years of evaluations, we have no reason to believe his status is going to change."

    Christopher went missing March 8, 2007, from the Brunswick mobile home park where he lived. His body was found a week later by a roadside, wrapped in trash bags.

    Prosecutors say George Edenfield, a neighbor, lured the boy into the mobile home he shared with his parents. The suspect's father later, David Edenfield, confessed in a videotaped police interview that he and his son took turns molesting Christopher while his wife, Peggy, watched. He said the boy pleaded with them to stop and threatened to tell his father and grandmother, prompting George Edenfield to begin choking the boy.

    David Edenfield told police he placed his own hands on top of his son's as Christopher choked to death. A jury convicted David Edenfield and sentenced him to death in 2009. Peggy Edenfield pleaded guilty to charges in the case and is serving a 60-year prison sentence.

    The joint request to have George Edenfield committed to a mental hospital infuriated the slain boy's grandmother, Sue Rodriguez. She stormed out of the courtroom Thursday in the middle of the hearing.

    "Where's the justice? Where is it?" Rodriguez said outside the courthouse. "Play like you're crazy, baby, and you'll go to a mental institution."

    But experts who evaluated George Edenfield in person and reviewed his history said he's mentally incapable of understanding the seriousness of the charges he faces or even what roles the judge, attorneys and jury would play at his trial.

    Psychologist Karen Bailey-Smith said Edenfield suffered an abusive childhood and tests have consistently shown he's impaired by mild to moderate mental retardation. In conversation, she said, he was often childlike and was prone to give different answers to the same questions if she changed her expression or tone of voice. Bailey-Smith said she asked Edenfield if he understood the death penalty.

    "He said, 'Well, I could get an injection and they'll put me to sleep,'" Bailey-Smith said, adding that she asked Edenfield how long he would sleep and he replied: "For a long, long time. Maybe the rest of my life."

    Psychologist Greg Cox performed Edenfield's latest mental evaluation, interviewing him at the Glynn County jail earlier this month. He testified that he slipped in a test used to detect people who are faking mental incompetence and concluded Edenfield wasn't pretending.

    Cox said Edenfield told him he looked forward to going to trial so he could return to the mental hospital. He said Edenfield told him: "I won the egg-decorating contest and won a coloring book. I can color better than I can draw."

    Both psychologists testified they concluded Edenfield lacked the ability to make crucial decisions to help his attorney at a trial, such as whether to testify in his own defense.

    "Would it be fair to say it is high unlikely this is going to get any better?" Gerald Word, Edenfield's defense attorney, asked Cox.

    The psychologist said he agreed.

    In today's Georgia Supreme Court opinions, Edenfield's conviction and sentence of death were AFFIRMED on direct appeal.

    Summary of appeal

    David Edenfield was convicted by a jury for murder and several other crimes for his role in the brutal sexual assault and death of six-year-old Christopher Barrios. Edenfield received the death penalty. He unsuccessfully moved for a new trial, and appealed the denial of that motion to the Supreme Court. Finding no reversible error, the Supreme Court affirmed Edenfield's conviction and sentence.
