    Summary of Offense:

    Was sentenced to death in September 1988 in DeKalb County for the robbery and murder of his 72-year-old grandmother and 15-year-old cousin. The bodies were found December 30, 1987. Both had been shot twice in the head at close range. Mr. Ferrell was on probation at the time. At the time of his grandmother's and cousin's killings, two of his uncles had killed a man and police initially thought the double homicide was revenge for that homicide. When arrested, police found four spent .22-caliber casings in Mr. Ferrell's pockets, along with $600. The murder weapon was later found at his home.

    The federal appeals court in Atlanta on Friday threw out the death sentence impose against Eric Lynn Ferrell, who shot and killed his grandmother and 15-year-old cousin in 1987.

    In a unanimous ruling, a three-judge panel of the 11th U.S. Circuit Court of Appeals found that Ferrell's lawyers at trial were ineffective because they failed to present jurors "very significant" mitigation evidence on their client's behalf. If they had, there is a reasonable probability the jury would not have sentenced Ferrell to death, the court said.

    Ferrell is now entitled to another sentencing trial.

    The 100-page ruling, written by Judge Stanley Marcus, said DeKalb jurors were not told that Ferrell suffered from extensive, disabling mental health problems and diseases, such as organic brain damage to the frontal lobe, bipolar disorder and epilepsy.

    Nor did jurors learn that Ferrell tried to attempt suicide at age 11 or that his father used to awaken him at night, strip him naked and beat him with razor strops and fan belts, Marcus wrote.

    Ferrell's grandmother, Willie Myrt Lowe, 72, and 15-year-old Tony Kilgore, who was visiting Mrs. Lowe during the holidays, each was shot twice in the head Dec. 30, 1987. Their bodies were discovered in a bedroom of Mrs. Lowe's home on Miller Grove Road.

    Ferrell was convicted of two counts of murder and armed robbery -- police found more than $600 in cash in Ferrell's pockets when he was arrested. A .22-caliber revolver later identified as the murder weapon was also found in Ferrell's home.

    I don't reckon they'll continue the case for another death sentence. Time will have taken its toll and the mitigating factors raised, more than likely outweight the aggravators. Time will tell though.

    I have to agree with you. With the mental/medical issues, a sentence of LWOP is warranted in this case. (Although it is the law, I don't agree!)

    Ferrell is now serving life. I am not sure whether he can apply for parole or not.
