    Cecil New II, Sentenced to LWOP in 2007 Slaying of 4-Year-Old César Ivan Aguilar-Cano

    Metro police have made an arrest in the Cesar "Ivan" Aguilar-Cano homicide case.

    Cecil Eugene New II, 46, a convicted sex offender, has been charged with murder in the death of the 4-year-old boy.

    The boy disappeared from outside his family's apartment near Churchill Downs on June 29. A city trash collector found the boy's body in the back of a truck eight days later.

    Shortly after the discovery, a search warrant was issued for New's home, which is located directly behind the apartment complex where the boy lived with his mother. According to the search warrant, police were able to identify where the trash container had been picked up.

    New has been on the Kentucky sex offender registry since 2000 after his conviction on a sodomy charge involving two youngsters.

    Publicity surrounding the search prompted New's attorney to hold a news conference to say that New couldn't return home because his safety had been jeopardized.

    New moved from the south end to west Louisville.

    In September, investigators confirmed that New was a suspect in the boy's death, and that they were awaiting DNA testing on evidence.

    Louisville Police spokesman Phil Russell said New was arrested Wednesday morning and charged with murder.

    Police have arrested a man suspected of abducting and killing a 4-year-old boy over the summer. Cecil Eugene New II, a convicted sex offender who was named as a person of interest early on in the case, was taken into custody at 5 a.m. Wednesday at 26th and Jefferson.

    Cesar "Ivan" Aguilar-Cano disappeared from outside his family's apartment on Oakdale Avenue near Churchill Downs on June 29. His mother reported him missing about 3:15 that afternoon.

    A city trash collector found his body in the back of a garbage truck eight days later.

    Louisville Police spokesman Phil Russell says New, 46, was arrested Wednesday morning and charged with murder. He lived just a few doors down from Ivan.

    New has been on the Kentucky Sex Offender Registry since March 2000 after being released from prison for sodomy involving 11- and 9-year-old family members in 1993.

    Family spokesman Christopher 2X said the victim's family was surprised when police informed them of the arrest early Wednesday morning. "They told his mom a couple weeks ago when we met with them that they were sorting out, they thought they were on the right path, some of the evidence was linking to somebody ... but she had no idea the news was going to broke this morning, nor did I or anybody else."

    2X says Ivan's mother, Rosalina Cano wept when she heard the news that police have arrested a suspect in her son's murder, and that her first question to police was if they knew why her son was killed.

    According to 2X, Rosalina was glad to hear that prosecutors plan to seek the death penalty if New is convicted.

    Police weren't able to answer that question, 2X said.

    People who lived in the neighborhood where Ivan disappeared were shocked by the brutal crime and relieved that an arrest has been made. "It was horrible thing for a grown man to do toa little child," said Brenda Wilson. "They couldn't protect themselves at all."

    Resident Gladys Brown lives across the street from New, and she told us she was not at all surprised that he's now the prime suspect in Ivan's murder. Brown says most people in the neighborhood didn't like New and tried to avoid him.

    New was named as a person of interest soon after the boy's body was found. According to a search warrant obtained by WAVE 3 News, police first searched New's apartment after search dogs picked up a scent. At the time, police said he was only a person of interest in the case, not a suspect.

    Investigators collected evidence from New's apartment during the first search, and New submitted a DNA sample.

    New is charged with murder, kidnapping, tampering with evidence, and unlawful transaction with a minor, as well as with being a persistent felony offender.

    Ivan was buried on August 17th in Guatemala, next to his great-grandparents.

    A convicted sex offender pleaded not guilty Thursday to kidnapping and killing a 4-year-old neighbor who was found in a garbage truck.

    A judge set a $1 million bail for Cecil Eugene New II during his arraignment in Jefferson Circuit Court.

    New was charged Wednesday with killing Cesar "Ivan" Aguilar-Cano, who disappeared near Churchill Downs on June 29. He was found in the back of a garbage truck eight days later.

    New is charged with murder, kidnapping, tampering with physical evidence and being a persistent felony offender. Prosecutors plan to seek the death penalty if he is convicted.

    New has been on the Kentucky sex offender registry since March 2000. He was convicted of sodomy involving 11- and 9-year-old victims in northern Kentucky.

    New's attorney, public defender Jay Lambert, filed a motion asking that all evidence in the case be preserved. A court date has been set for Jan. 23.

    Ivan was buried in his mother's hometown of San Juan Tapalapa, Guatemala, in August. His mother, Rosa Cano, who is in the United States illegally, was granted a special visa allowing her to leave and return to the country as a material witness in the criminal investigation.

    Prosecutors say they will seek the death penalty for a man accused of kidnapping and killing a 4-year-old boy.

    Prosecutors say Cecil Eugene New is eligible for the death sentence because he is accused of kidnapping Cesar "Ivan" Aguilar-Cano, not returning him, and killing him. The Jefferson County commonwealth's attorney filed the notice with the court on Wednesday.

    New has pleaded not guilty to charges of murder, kidnapping and three other felonies.

    The boy was last seen on June 29 in front of his apartment near Churchill Downs. His body was found a little over a week later.

    The Courier-Journal reports that a judge set a hearing for Feb. 6 on whether to seal evidence in the case.

    A registered sex offender charged with murdering a 4-year-old boy last summer has been attacked in jail.

    Louisville Metro Corrections spokeswoman Pam Windsor said Cecil Eugene New II was attacked by a fellow inmate on Wednesday while being escorted back to his cell from a shower.

    That inmate, whose name was not released, was out of his cell serving as a work aide in the jail, Windsor said.

    Jail staff members were able to separate the two men quickly, Windsor said. New suffered minor bumps and bruises, Windsor said. His attacker now faces internal discipline.

    New is being isolated in a cell because of his high-profile case and the nature of his charges; however all of the inmates are given an hour out of their cell each day to shower, Windsor said.

    Prosecutors say DNA evidence links a Louisville man to a 4-year-old boy whose body was found in a trash dump.

    Jefferson County Commonwealth's attorneys say that two hairs found in Cecil Eugene New's apartment match Cesar Ivan Aguilar-Cano's DNA.

    New is charged with kidnapping and killing the child last summer.

    Prosecutors were in court on Monday to ask a judge for permission to do DNA tests on four additional hairs found on the boy's shirt, The Courier-Journal reported.

    The Commonwealth's Attorney's Office says that at least one hair is "microscopically" similar to hairs taken from New.

    Because of the deterioration of the hairs, a DNA analyst believes further testing will destroy them, so Assistant Commonwealth's Attorney Jon Heck asked Circuit Court Judge Judith McDonald-Burkman for permission to do the tests.

    Defensive attorney Jay Lambert asked to delay the testing to determine if other tests may need to be done first before the hairs are destroyed.

    Circuit Court Judge Judith McDonald-Burkman did not rule on the DNA tests on Monday. Another court date has been set for April 30.

    LOUISVILLE, Ky. -- The sexual orientation of a Louisville man accused of molesting and killing a 4-year-old boy is at the center of a court argument.

    Cecil New II faces the possibility of the death penalty for the slaying of Ivan Cano.

    New's homosexuality is at the center of an ongoing debate in this case.

    About 20 years ago, New was convicted of the rape and sodomy of his niece and nephew.

    Prosecutors have already indicated they won't bring that criminal past up during trial because under the rule of evidence, it would not be allowed because it would prejudice the jury.

    However, the commonwealth does want to produce evidence that New is a homosexual.

    Prosecutors said that evidence will provide motive for the 2007 sexual assault and slaying of Cano.

    "Judge we cannot disagree more in introducing this evidence. There is a huge difference between a consensual adult sexual relationship, either hetero or homosexual, and a sexual assault of a child," said defense attorney Misty Clark.

    A date is set next month for Cecil New’s official sentencing and prosecutors say they'll still go after the death penalty for the man who pleaded guilty to killing four-year-old Ivan Cano. New surprised nearly everyone, including police and prosecutors, by pleading guilty to murdering Ivan Cano on the eve of what was supposed to be the start of his trial.
    On Monday the judge overseeing the case officially set a date for his sentencing. The community's response to the disappearance and death of Ivan Cano is etched in most of our collective memories. There were missing child posters, dogs, door to door searches, and then the grisly discovery of the young boy's decomposing body in a garbage truck. “It had an impact on the whole community,” said victims’ advocate Christopher 2X.
    Soon there was a suspect in registered sex offender Cecil New, who lived down the street from Cano and admitted early on to police that he often saw the boy playing unattended. Soon, thousands of stories about the case appeared in the media. However, after dozens of hearings, in which New's attorneys argued their client should be tried somewhere besides Louisville, the case was ready to proceed until a mid-October surprise one day before jury selection. New pleaded guilty to murder, tampering with physical evidence and unlawful transaction with a minor. It saved the Commonwealth of Kentucky a long, emotionally painful trial.
    “The court's done a good job of keeping the evidence in this case under sea,” said prosecutor Jon Heck. When the evidence was made available to the public, there was more than 7,000 pages of it. Included was information that New failed a polygraph test, evidence he rode his bicycle more than 140 miles after becoming a suspect, and his admission that he videotaped stories about Ivan Cano and has been attracted to children since 1992.
    The plea did not come attached to any deal, so the judge could decide to sentence New to death. That hearing has been scheduled for November 15th.

    Witnesses testify on first day of New sentencing proceedings

    LOUISVILLE, KY (WAVE) - Day one of a sentencing hearing for the man who pleaded guilty to killing a 4-year-old boy in July of 2007 has wrapped up. Although Cecil New pleaded guilty before going to trial, Monday's sentencing played out like a trial, with prosecution witnesses arguing for the death penalty.

    One day before his trial was set to begin in October, New pleaded guilty to murder, kidnapping, tampering with physical evidence and unlawful transaction with a minor in connection with the death of 4-year-old Ivan Cano.

    During Monday's proceedings, witnesses took the stand to talk about some of the factors the Judge Judith McDonald-Burkman should consider before ruling on whether New will be sent to prison for life or sentenced to death.

    On Monday, the judge ruled New's 1992 convictions in the rape and sodomy of his niece and nephew show a substantial history of assaultive behavior.

    Cano's mother, Rosalina, went before Judge McDonald-Burkman around 11:30 a.m. When we spoke with her by phone Sunday night, she told us she does not want the death penalty for New because she doesn't want to see another family suffer.

    A homicide detective also took the stand to discuss the day in 2007 when Cano's body was found in a garbage truck. The testimony was graphic and emotional, and Cano's parents were in the courtroom listening to all the details. At one point, his dad had to walk out.

    The defense will make its case Tuesday morning, and then the judge's sentence is expected.

    LOUISVILLE, KY. (WDRB Fox 41) -- It was rare sign of emotion in court Tuesday from a admitted child killer Cecil New. He has shown very little emotion over the last three years, but Tuesday he could not hold back the years as he listened to one of his sisters on the witness stand.

    New's younger sister told the court about their childhood and abusive father, who was also an alcoholic. During her testimony, New's tears were coming down non-stop at one point.

    Last month, New pleaded guilty to kidnapping and murdering 4-year-old Ivan Cano in June of 2007. Defense attorneys are trying to save New from the death penalty by showing he had a troubled childhood.

    Cecil New's mother was next to take the witness stand. She told the court that her now deceased husband, Cecil New, Senior was ashamed and embarrassed that New and his older brother were both gay.

    She also told the court about a time when her husband broke her ribs. She also said her husband sexually abused two of his daughters, even impregnating one of them. The pregnancy was eventually terminated.
