    No decision in Marcus Ray Johnson clemency hearing

    Lawyers for a Dougherty County man set to die this week for a 1994 Albany murder went before the Georgia Board of Pardons and Paroles Monday to plead for mercy.

    Late Monday afternoon, the board said there would be no decision on clemency for Marcus Ray Johnson Monday.

    He's scheduled to be executed Wednesday for the brutal rape and stabbing death of Angela Sizemore.

    This was a day long hearing with the defense team starting at 9:00 Monday morning and District Attorney Greg Edwards and family members who presented their arguments Monday afternoon. Johnson's attorneys say there are troubling inconsistencies in the state's case, but Edwards feels differently.

    In a last ditch effort before his scheduled execution Wednesday both the defense and prosecution once again argued the facts in the Marcus Ray Johnson case before the five member Board of Pardons.

    "They're looking to see if there's any reason based on any part of the state's investigation or something compelling from the defense representation that they should withhold the state execution," said Dougherty District Attorney Greg Edwards.

    Defense attorneys from the Georgia Resource Center contend there are enough questions about Johnson's conviction to warrant a new trial, they're questioning the DNA evidence, but the District Attorney stands by the conviction and evidence.

    "There's no evidence that indicates that there was anybody else there, but even if there was anybody else there like I said, none of it exonerates, nothing removes him from the crime," said Edwards.

    Defense attorneys made their arguments this morning and after lunch for two and a half hours Edwards explained to the board whether there was someone else there as the defense contends doesn't matter, all of the other evidence supports Johnson as being there.

    "The eyewitness testimony, the physical evidence, his statement's to the police, all of these things are still part of the case," said Edwards.

    Angela Sizemore's family also had their say.

    "They continued to say that they believe that justice should be served in this instance, they expressed their feelings about how the case transpired," said Edwards.

    While Marcus Johnson wasn't there in person, senior Clemency staff did conduct and interview with him and provided that statement to the five member board to consider in their decision.

    There are two separate hearings Tuesday here in Dougherty County, one in the morning on several motions including DNA and a request for a new trial and a hearing in the afternoon in regard to evidence the defense claims the city withheld.

    Marcus Ray Johnson's is scheduled for execution by lethal injection Wednesday night at 7:00.

    He would be the 30th inmate put to death by lethal injection in Georgia.

    Johnson wants new DNA test

    Condemned murderer Ray Johnson's lawyer is in a Dougherty County courtroom, trying to get new evidence testing, attempting to save his life.

    In Judge Willie Lockette's court, defense attorney Brian Kammer is arguing that DNA evidence from the murder of Angela Sizemore in 1994 can be retested, using new procedures that were not available back then.

    He suggested the suspect touched all of Sizemore's clothes and they should be retested.

    Dougherty D. A. Greg Edwards is going back through witness accounts at the original trial that put Johnson in the Fundamentals bar with Sizemore, and on eastside after she was murdered, near the holding pond where Sizemore's body was found in her Chevy Suburban.

    He's asking that the request for a new trial and DNA testing be dismissed.

    Kammer wants what he called "Touch DNA" testing to be done. He says that this could shed new light on a greasy substance on some of Sizemore's clothing, as well as mucus and saliva on the fabric.

    The defense also argued that there was not enough blood present at either of the locations where Sizemore was to account for the 41 stab wounds that she suffered.

    He said that could prove that someone else was involved, or that just Marcus Johnson was present during the murder, but it could exclude him.

    Edwards argues that exhaustive testing has been done, and even if someone else may have been present when Sizemore was killed, that doesn't clear Johnson.

    Johnson is set to be put to death tomorrow evening at the state prison in Butts County.

    Ga. delays Wednesday execution

    An attorney for a Georgia death row inmate says Wednesday's scheduled execution has been delayed.

    Attorney Brian Kammer says a stay has been granted for Marcus Ray Johnson, who was convicted in the 1994 rape and murder of Angela Sizemore. Authorities say the Albany woman was stabbed to death 41 times shortly after the two met at an Albany nightclub.

    Georgia Supreme Court upholds inmate's stay of execution

    The Georgia Supreme Court on Wednesday refused to lift a stay of execution ordered for a death row inmate seeking more DNA testing and time to review new evidence in his case.

    Marcus Ray Johnson, 46, had been scheduled to die by lethal injection on Wednesday for the 1994 rape and murder of Angela Sizemore in Albany, Georgia.

    But Dougherty County Superior Court Chief Judge W.E. Lockette had on Tuesday delayed the execution and set a hearing for February to determine the merits of Johnson's request for additional DNA testing and a new trial.

    Defense attorneys also said they needed time for their experts to examine what they said was a new box of physical evidence that had only recently been supplied by the Albany Police Department.

    Dougherty County District Attorney Gregory Edwards filed an emergency motion asking the state Supreme Court to vacate the judge's order granting the stay.

    The court, in a unanimous vote, dismissed the state's appeal on procedural grounds, meaning Johnson's execution won't be carried out until at least early next year.

    Lawyers have conflict with death penalty hearing

    Albany, Ga. - An Albany hearing for condemned killer Ray Johnson won't likely happen as planned in February.

    Johnson's lawyers put the court on notice that they have a schedule conflict in the February 1st hearing.

    Johnson is on death row for the 1984 murder of Angela Sizemore.

    He picked her up at a bar, raped and stabbed her to death.

    He was supposed to be executed earlier this month, but got a last minute stay of execution.
