New execution date set in 2002 murder of Susan Pittman, daughter
A new execution date for Dorian Frank O’Kelley today was set in the 2002 slaying of Susan Pittman and her daughter, Kimberly.
O’Kelley, whose 2005 sentence has been affirmed by the Georgia Supreme Court, was back in Chatham County Superior Court today for an adjustment to its original sentence by Judge James Bass, Jr.
In line with an Applet court ruling, Bass vacated an arson sentence, but left the total death sentence plus life plus 40 years in prison.
Meanwhile, the Georgia Supreme Court today affirmed the death sentence for Darryl Scott Stinski n the 2002 slaying of Susan Pittman and her daughter, Kimberly.
The court’s 46-page unanimous ruling, written by Justice Hugh Thompson, rejected one-by-one the 68 alleged errors cited by the defense.
It did reverse one of two arson sentences and returned the case to Chatham County Superior Court for resentencing.
“We conclude upon our review of the record that the evidence was sufficient to authorize a rational trier of fact to conclude beyond a reasonable doubt that Stinski was guilty of the crimes for which he was convicted,’’ Thompson wrote.
A jury selected in Macon convicted Stinski, then 23, in Savannah of killing Pittman, 421, and her 13-year-old daughter, Kimberly, during a burglary at their Whitfield Avenue home April 10, 2002.
Stinski then burned the house to the ground to conceal the crimes.
The jury recommended the death sentence for Stinski.
Jurors returned the convictions and sentence in June 2007; the Supreme Court heard the oral argument in the case in October.
Co-defendant Dorian Frank O’Kelley, 24 at the time, also was convicted in a separate trial and sentenced to death. The state’s high court affirmed those convictions in November. The court also returned the case for resentencing after finding that only one arson, not two, occurred.
The pair went to the Pittman house where they turned off the power and found the victims asleep in separate bedrooms, the record showed.
They attacked Pittman first, beating her with a flashlight, a walking cane and a lamp. During the attack, Pittman was stabbed three or four times in the chest and abdomen.
When Kimberly Pittman awoke to her mother’s screams, Stinski took the child upstairs where he bound her wrists and gagged her. While Stinski went downstairs to search for items to steal, O’Kelley went upstairs where he raped the girl. Stinski went upstairs where he hit Kimberly Pittman in the head with a baseball bat as she knelt on the floor, the trial record showed.
O’Kelley slit her throat with a knife, Stinski then hit her in the knee with the bat and O’Kelley tried to suffocate her before stabbing her in the torso and legs. After kicking her and throwing things at her, the pair set the pair set the house afire while she was still alive.
