    Lawrence Rice Sentenced to Death

    MARIETTA - Convicted murderer Lawrence Rice was sentenced to death Wednesday afternoon by a Cobb Superior Court jury.

    Rice, 58, of Tucker, showed no emotion as he stared at Judge Mary Staley, who read the jury's verdict aloud. Shortly afterwards, he took a drink from a cup and sat back in his chair.

    Rice was sentenced to death by the 12-member jury on two counts of malice murder and two counts of felony murder. Staley also sentenced him to 20 consecutive years in prison on one count of burglary.

    Marlee Mincher, the only surviving member of her immediate family of four, was greeted with hugs and comforting smiles from relatives and friends who filled nearly half the courtroom.

    She declined to speak with reporters after the verdict.

    After the sentence, Connie Mincher's brother, Damon Sticher, read a statement.

    "The guilty verdict is the verdict that we were hoping and praying for," Sticher, 57, of Douglasville, said, according to other media accounts. "And we realize that there are no winners here today."

    Staley told the family that she knew how difficult the proceedings had been for them, but that she thought they acted "respectful" during the five-day trial.

    Nearly a dozen Cobb Sheriff's Office deputies lined the courtroom as the verdict was read. They escorted Rice into custody after the jurors were excused.

    Rice was convicted by the same jury on Monday for killing the wife and son of his former supervisor, Trevor Mincher, in April 2003. Connie, 47, and 14-year-old Ethan Mincher, then a Pope High School freshman, were found bludgeoned to death in their east Cobb home by then 12-year-old Marlee Mincher, who had returned from school.

    Trevor died of cancer in 2005.

    The jury - which began sentencing deliberations Tuesday evening - had the option of sentencing Rice to life in prison with the chance of parole; life in prison without parole; or the death penalty.

    Cobb District Attorney Pat Head said he felt the death sentence was an appropriate verdict given the nature of the crime. State law dictates that at least one of 10 aggravating circumstances, outlined by the General Assembly, must be present to file for the death penalty.

    "I think the brutal murder of two individuals, and especially a 14-year-old innocent child, are good reasons to seek a death penalty," Head said.

    In 1990, Rice resigned from Video Tape Associates in Atlanta after about three months on the job because of a salary dispute. He blamed his coworker, Trevor Mincher, for "blackballing" him from getting another broadcast engineering job.

    The key evidence for the prosecution in the trial were 138-pages of a journal, written by Rice, that prosecutors said outlined the grudge he maintained against Mincher and his motives for murder.

    Head said he believed the 1999 case of convicted murderer and child molester Virgil Delano Presnell Jr. was the last time a Cobb jury imposed the death penalty.

    After his original death sentence was overturned, it was reinstated after he was prosecuted in 1999. He is on death row in a state prison in Jackson.

    The Georgia Supreme Court on Monday unanimously upheld the death sentence against a man who killed a woman and her 14-year-old son in their east Cobb County home.

    Lawrence Rice sits on death row for the April 17, 2003, killings of Connie Mincher and her son, Ethan, a Pope High School freshman. The two victims sustained multiple wounds that a medical examiner found to be consistent with being struck repeatedly by a hatchet. Rice had a longstanding vendetta against Mincher’s husband, who once employed Rice at an Atlanta video company, prosecutors said.
