    too bad he can only be executed ONCE. His brothers should be executed also. on the same day would be nice!!!

    I am pretty sure this is a first. I have never heard of someone who is convicted of the same crime pressing for appeals of a co-defendant. Usually it's the mother of the condemned, or the ACLU filing appeals on inmates behalf who have dropped appeals.

    Judge Rejects Appeal from Condemned Man's Brother

    A Georgia judge on Thursday rejected an appeal by a death row inmate's brother that would postpone the condemned man's scheduled execution next week.

    The order, signed by Butts County Superior Court Judge Thomas Wilson, clears the way for Nicholas Cody Tate to be executed on Tuesday for the 2001 murders of a Dallas, Ga., woman and her 3-year-old daughter.

    Death penalty cases typically take well over a decade to work through the appeals process, but Tate has refused to challenge his conviction and death sentence through habeas corpus appeals. His brother, Dustin Wade Tate, sought to file an appeal on his behalf but Thursday's order concludes he wasn't able to prove the inmate was "incompetent."

    The inmate's current and former attorneys won't comment on why Tate, who is 31, won't let them file the appeal, although a transcript from a 2009 hearing highlights his thoughts on the process.

    "You caught me red-handed," he said during the hearing, when he waived his motion for a new trial. "None of my rights were violated ... I choose to waive any and all future appeals."

    According to court records, Nicholas Tate and two of his younger brothers, Dustin and Chad, purchased ammo, duct tape and knives at a local sporting goods store in December 2001 and then plotted to use the weapons to burglarize the home of Chrissie Williams, who they believed had a stash of drugs and money.

    When they arrived at the home, Chrissie's 3-year-old daughter Katelyn answered the door, and chaos ensued. The men tried to knock Chrissie out with a stun gun, but when she didn't lose consciousness they taped her mouth and eyes shut and handcuffed her hands to a bed.

    They moved Katelyn to another room, where Nicholas Tate removed her pajamas and sexually assaulted her. Nicholas Tate, who prosecutors say was the plot's ringleader, ordered Chad to silence the girl because she recognized him. Chad Tate unsuccessfully tried to strangle her with a telephone cord, and he then used Nicholas' knife to slit her throat.

    Dustin Tate fled the house in fear. Nicholas Tate put a seat cushion over Chrissie's head as she lay bound to the bed, firing one shot through the pillow to kill her.

    The three brothers then fled Georgia and traveled to Mississippi where they captured a 23-year-old woman from a gas station where she worked and forced her into an SUV. The three later released the woman but kept her car as they sped toward Oklahoma.

    The Tate brothers abandoned their weapons at a motel and drove to El Reno, which is about 30 miles outside of Oklahoma City. They then contacted their parents in Dallas, Ga., who helped them negotiate their surrender to police.

    Nicholas Tate pleaded guilty to murder charges in November 2005 and was sentenced to death a month later. His brothers also admitted to committing the violence. They are serving life sentences in prison, and Dustin Wade Tate sent the appeal this month on his behalf.

    Nicholas Tate filed a motion for a new trial in 2006, but three years later he had a change of heart. That's when he said he wanted to waive all future appeals, and a trial judge accepted his request, noting that he was coherent and articulate.

    His attorneys went ahead with a direct appeal, asking the Georgia Supreme Court to overturn the sentence. Among the arguments they made was that the punishment was disproportionate because neither of his two brothers were sentenced to death.

    But the court's June 2010 ruling rejected that argument along with the others in upholding the death sentence. The court ruled that Chad Tate, who was 15 at the time of the killings, wasn't eligible for the death penalty and that Dustin Tate's life was spared because he was neither the killer nor the "driving force" behind the victims' deaths.

    The Board of Pardons and Paroles is meeting Monday to review the case of Nicholas Cody Tate, who is to be executed Tuesday for the 2001 murders of a Paulding County woman and her 3-year-old daughter.

    Tate has exhausted his automatic appeals but refused to challenge his conviction and death sentence through habeas corpus appeals, which could last for years. He waived his appeal rights at a 2009 hearing, saying "you caught me red-handed."

    Condemned murderer Nicholas Cody Tate is scheduled for execution by lethal injection at 7:00 p.m. on Tuesday, January 31, 2012, at Georgia Diagnostic and Classification Prison in Jackson. Tate was sentenced to death for the 2001 murder of Chrissie Williams and her 3-year-old daughter, Katelyn Williams.

    Media witnesses for the execution are: Greg Bluestein, The Associated Press; Jessica Loeding, The Daily-News Tribune; and Daniel Beauregard, The Champion Newspaper.

    Tate declined to request a special last meal and instead will be offered the institution’s meal tray, consisting of shepherd’s pie, mashed potatoes, red beans, cabbage relish salad, collard greens, corn bread, cookies and iced tea.

    There have been 52 men executed in Georgia since the U.S. Supreme Court reinstated the death penalty in 1973. If executed, Tate will be the 30th inmate put to death by lethal injection. There are presently 95 men and one woman on death row in Georgia.

    I don´t expect that anyone will stop this execution. At least he´s one of those who take responsibility for their crimes. No one should take him this possibility to show a little piece of "humanity".

    A Georgia prison inmate who has refused to challenge his death sentence was set to be executed Tuesday for leading a violent robbery that left a woman and her 3-year-old daughter slain at their Paulding County home.

    Nicholas Cody Tate was scheduled to be put to death by injection at 7 p.m. in the state prison in Jackson for the murders of Chrissie Williams and her daughter Katelyn.

    His case presents a host of challenges to Georgia's legal system because it has moved rapidly through the death penalty process. That's because Tate has refused to challenge his conviction and death sentence through habeas corpus appeals, a process that could have postponed his execution for years.

    Tate's attorneys last week abandoned an attempt to have the condemned man's brother file an appeal on his behalf, and the pardons board on Monday rejected his request for clemency. It's unclear whether the lawyers will file the last-minute appeals to state and federal courts that are typical in these cases.

    The likeliest route for Tate to halt his execution is to file the habeas appeal, and he has given no indication he will do so. His current and former attorneys won't comment on why the 31-year-old won't let them file the appeals, but Tate's remarks at a 2009 hearing reveal his some of his thoughts.

    "You caught me red-handed," he said during the hearing, when he waived his motion for a new trial. "None of my rights were violated ... I choose to waive any and all future appeals."

    Friends and family of the victims were hopeful the execution would not be delayed.

    "Justice needs to be served," said Kellie Young, Chrissie's older sister.

    The men knocked on the door and when Katelyn answered, chaos ensued. Tate ordered his brother Chad to silence the girl.     Georgia prison officials say they are postponing Tuesday evening's scheduled execution of a death row inmate for the 2001 murders of a woman and her 3-year-old daughter.

    Georgia Attorney General spokeswoman Lauren Kane said the execution of Nicholas Cody Tate was postponed because he was planning to file an appeal.

    What a disappointment for the family.

    Friends and family of the victims said they were disappointed by the news. Kellie Young, Chrissie's older sister, said state attorneys contacted her late Tuesday with news that Tate was going to file an appeal.

    "We're going to go through the courts again," she said. "I'm still in shock. I wanted closure. We just have to hope things turn out the way they should."
