    Death penalty sought in double murder case

    The Cole County prosecutor's office has filed court documents showing it intends to seek the death penalty in the case of a Jefferson City man charged with a double murder Sept. 28.

    During a case status hearing Wednesday, David Hosier, 54, was informed of the action by Presiding Judge Pat Joyce.

    No date was set for Hosier's next court appearance. He is currently being held in the Morgan County Jail in Versailles for Cole County.

    Hosier is charged with one count of firstdegree murder, armed criminal action, firstdegree burglary and unlawful possession of a firearm by a felon in connection with the death of Angela Gilpin.

    He's charged with first-degree murder and armed criminal action in the death of Rodney Gilpin.

    The Gilpins died from multiple gunshot wounds.

    He has pleaded not guilty to these charges.

    About seven hours after the Gilpins were killed in the hallway just outside her apartment at 1100 W. High St., Hosier was arrested by Oklahoma officials on a Jefferson City police bulletin.

    The Gilpins were separated at the time of the shooting, but were working on reconciliation. Angela had been in a relationship with Hosier during the separation, but had ended it, officials said.

    Hosier seeks change of venue for murder trial

    Lawyers for a man accused of killing two Jefferson City residents in September 2009 are asking that his murder case be moved on a change of venue.

    During a hearing Tuesday at the Cole County Courthouse, Public Defender Donald Catlett presented documents to Presiding Judge Pat Joyce on behalf of his client David Hosier, 54, who was not at the hearing. He is being held in the Morgan County Jail for Cole County.

    Hosier is charged with one count of first-degree murder, armed criminal action, first-degree burglary and unlawful possession of a firearm by a felon in connection with the death of Angela Gilpin. He’s also charged with first-degree murder and armed criminal action in the death of Rodney Gilpin.

    Hosier has pleaded not guilty to the charges and is facing the death penalty.

    Judge to weigh jury pools for Hosier trial

    A decision on where jurors will be imported to hear the case of Jefferson City man accused of killing two people in September 2009 should be made in a few days.

    Lawyers for David Hosier, 54, and Cole County Prosecutor Mark Richardson appeared at a Thursday hearing before Cole County Presiding Judge Pat Joyce.

He’s also charged with first-degree murder and armed criminal action in the death of Rodney Gilpin.

    Kansas City area jury to hear double-murder case

    A jury from the Kansas City area will hear a 2009 Jefferson City double-murder case.

    Cole County Presiding Judge Pat Joyce notified both sides in the case of David Hosier, 54, that the jury will be selected from Clay County, and the case will be tried in Cole County.

    No date for the trial has been set.

    Hosier is charged with one count of first-degree murder, armed criminal action, first-degree burglary and unlawful possession of a firearm by a felon in connection with the death of Angela Gilpin. He’s also charged with first-degree murder and armed criminal action in the death of Rodney Gilpin.

    Trial date set in Hosier double-murder case


    The trial for a man accused of a 2009 double murder in Jefferson City has been scheduled for June 2012.

    The trial date for David Hosier, 54, was set at a status hearing Wednesday before Cole County Presiding Judge Pat Joyce.

    Verdict in for former Logansport man accused of murder

    Jurors from St. Charles County in Missouri deliberated for just over an hour, then convicted David Hosier of first-degree murder for killing Angela Gilpin in September 2009.

    They also found the former Logansport man guilty of armed criminal action, burglary and being a felon in possession of a weapon. The jury returns at 9 a.m. Thursday to decide if Hosier should get the death penalty for the murder conviction.

    The trial of a Jefferson City man accused of killing a couple just over four years ago started on Monday.

    Jury recommends death in Hosier trial

    The jury in the David Hosier murder trial recommended he be sentenced to death.

    During closing arguments, prosecutors told jurors when Hosier took a life, he forfeited his own.

    He was convicted earlier this week for the murder of Angela Gilpin, among other charges.

    To recommend the death penalty, the jury said the prosecution proved two aggravating factors in the case. The first was a prior conviction for battery. The second was the murder of Angela Gilpin was committed while committing the murder of Rodney Gilpin.

    A formal sentencing date has not been set.

    The defense told jurors during closing arguments that no matter what, Hosier is never getting out of prison, and will no longer be a threat to women he feels betrayed him or abandoned him.

    His attorneys also said Hosier makes threats, but does not act on them.

    They also pointed out he has been in jail since 2009 and has not been violent toward anyone.

    The jury was told even if they prove one or more of the aggravating factors against Hosier, they are not obligated to recommend the death penalty.

    During other testimony Friday morning, a woman named Lisa Browning took the stand Friday morning to say David Hosier lived on the property owned by her and her husband in 2007.

    Browning told the court Hosier’s behavior was very erratic, and at times it seemed like he wasn’t sleeping, while at others he seemed fine.

    She testified her husband Ron was about to travel to Montana for work, but she did not want Hosier on their property while he was gone. When the time came to tell Hosier he needed to leave, Lisa Browning told the court she waited inside the house with a shotgun while her husband told Hosier the news.

    She said Hosier at one point pulled a gun on her husband before finally driving away.

    David Hosier’s older sister also took the stand. Defense attorneys showed her pictures from Hosier’s childhood along with pictures from right after their father was killed. She talked about how their father’s death impacted Hosier.

    Motion for new Hosier trial denied

    Cole County Presiding Circuit Judge Patricia Joyce on Tuesday denied a motion for a new trial for David Hosier, convicted in the September 2009 killing of Angie Gilpin.

    Joyce on Tuesday ordered the death penalty be handed down in the case.

    A nine-man, three-woman jury from St. Charles County deliberated for just more than an hour on Oct. 23 before convicting Hosier, 58, of first-degree murder for killing Gilpin, 45, on Sept. 28, 2009.

    The same jury spent about two hours and 45 minutes on Oct. 25 before recommending Hosier be executed for that murder.

    Hosier's public defenders, Donald Catlett and Janice Zembles, had asked Joyce to overturn the convictions and hold a new trial. They had filed a 46-page motion raising 46 issues with procedural decisions Joyce made during the trial or the various pre-trial hearings.

    Motive in Hosier Case

    JEFFERSON CITY -- Police said the manhunt is over in a double murder in the Capital City.

    Authorities in Oklahoma arrested David Hosier, 54, of Jefferson City.

    The arrest came about eight hours after the murder. The Tahlequah Daily Press reported he attempted to flee when the sheriff's office, Oklahoma Highway Patrol, Tahlequah Police and Oklahoma Scenic Rivers Commission rangers tried to stop his vehicle.

    Hosier is in the Cherokee County Detention Center in Tahlequah, Okla. Jefferson City police are on their way to Oklahoma to interview Hosier.

    Police said Hosier's quick capture was thanks to an all-points-bulletin, APB, they sent out to law enforcement agencies across the country to look for the 2000 Black Pontiac Grand-Am he was driving.

    He was arrested for the murders of Rodney Gilpin, 61, and Angela Gilpin, 45.

    The couple was found shot to death around 3:30 this morning in the entry way of their apartment building in the 1100 block of West High Street.

    "We received a 911 call from a resident of the building who stated that she was concerned that she saw her neighbors lying in the doorway or the hallway of an apartment in this building," Jefferson City Police Department Capt. Mike Smith said.

    Angie Gilpin's mother said her daughter was probably leaving for her job at a Wardsville Convenience store when she was gunned down.

    Police said it was Hosier, her neighbor, waiting for her as she left her apartment for work.

    Hosier would have known when Angie normally left; the two reportedly had a relationship while Angie was estranged from her husband.

    Angie's mother said her daughter and her husband were getting back together, which is why he was at her apartment this morning.

    Family and police said that may have been motive for the murder.

    "What little we do know is that the relationship was tumultuous and that the female victim did not want a relationship with Hosier,” Smith said.

    Police said Hosier lived on West Main Street in an apartment building on the same property as the building where the murders happened.

    The landlord said he was evicting Hosier because of he was bothering Angie.

    Angie's mother also said that Hosier had been harassing her daughter over the past couple of months.

    Police said they found ammunition inside of Hosier's apartment.

    The landlord was terribly upset this happened on his property. And that he didn't know Hosier had out-of -state warrants for his arrest.

    The murders put the entire neighborhood, including nearby Heisinger Bluffs retirement home, on high alert.

    “It’s the first thing we do,” Smith said. “As you can see from the amount of crime tape out here, we’ve secured quite an area just to make sure that we’ve got any possible evidence covered. The officers are out doing a neighborhood canvas.”

    Police quickly went door to door with flashlights looking for the killer and asking neighbors if they saw anything.

    "The police, when I got home this morning, asked me about all of this stuff because I guess, what they said, the murder was about 3:30,” neighbor Brian Truedonnelly. “So it’s sort of scary that I was out there about that time. But I didn't really see anything."

    Hosier is originally from Jefferson City and has family there.

    Supreme Court set to hear David Hosier death sentence appeal

    Today marks the fifth anniversary of Angela and Rodney Gilpin’s murders.

    Thursday morning, the Missouri Supreme Court will hear arguments on David Russell Hosier’s appeal of his conviction and death sentence for killing Angela, 45 — an appeal that state law says automatically must be heard by the seven-member high court.

    Cole County Presiding Circuit Judge Pat Joyce imposed the death sentence 10 months ago, after a nine-man, three-woman jury from St. Charles County convicted Hosier following a late-October trial, then recommended that he be executed.

    Family members couldn’t be reached to comment for this story.

    But during Hosier’s Nov. 26 sentencing hearing, Angela’s mother Barbara Eichholz said: “There is no way to express the loss of a daughter. No one should have to bury a child.

    “I’ve lost sleep and interest to do some of the simple things in life.

    “It’s hard for me to believe I will never hear her giggle again.”

    At that same hearing, Hosier, now 59, told Joyce: “I stand here now convicted of a crime I didn’t commit.

    “I had a father and a cousin who were murdered, and I would never want a family to go through that.

    “I know I committed adultery for having an affair with a married woman, but I did not kill her, and I didn’t kill Rodney. I loved them both.”

    Hosier said he didn’t “get a fair trial” because he wasn’t able to present some favorable evidence.

    The Gilpins’ bodies were found about 3:30 a.m. Sept. 28, 2009, lying in the doorway of Angela’s apartment in the 1100 block of West High Street, by a neighbor returning from an out-of-town trip. She called 911.

    The Gilpins had been married 21 years, and were reconciling after a separation.

    During that separation, Angela had dated and become friends with Hosier, who lived in an apartment on West Main Street, located across the parking lot and up the hill from where Angela lived.

    Investigators and prosecutors said that, when Angela said she wanted to restore her marriage with Rodney, Hosier was angry and told others that, if she “would not come back with him,” then he “would put a stop to it somehow.”

    Cole County Prosecutor Mark Richardson argued during the trial last October that Hosier knew Angela left about 3 a.m. to go to her job as a convenience store manager in Wardsville.

    That Monday morning, Richardson said, Hosier waited in the hallway just outside her apartment door until she opened the door to leave for work, then fired a number of shots from a home-made STEN submachine gun, killing both Angela and Rodney.

    Within five hours after the killings, and after police learned of the on-again off-again romance, officers applied for and received search warrants to look inside Hosier’s apartment and to have AT&T “ping” Hosier’s cell phone so they could locate him.

    After Jefferson City officials had notified law enforcement in several states to look for Hosier and stop him as a suspect in the double murder, Oklahoma Highway Patrol officers began pursuing Hosier’s car near Tahlequah, in what his appeal describes as a “moderate-speed” pursuit. At one point, his appeal attorney wrote, “one law enforcement vehicle partially blocked the road, but David went around it and continued to drive southbound.”

    By 11 a.m., Hosier had stopped his car, gotten out of it and asked the officers to “shoot me, and get it over with” or “end it.” Officers eventually were able to handcuff him and take him into custody.

    Armed with a search warrant they got after flying in to Tahlequah, the Jefferson City officials searched Hosier’s car and, according to the appeal, “found a STEN submachine gun” and a number of other items, including other firearms and ammunition.

    In a 121-page brief to the Supreme Court, Hosier’s attorney — Assistant Public Defender Craig A. Johnston — argues the case was riddled with procedural problems from the start of the investigation, and Joyce “erred in overruling” the attorneys’ motion to suppress most of the physical evidence.

    The appeal says police had no probable cause to search Hosier’s apartment or get AT&T to “ping” the cell phone “because the affidavit supporting the application for that order merely asserted that David had ‘been identified as the primary suspect in the homicide investigation’ without any factual support for that conclusory assertion.”

    Additionally, the appeal brief argues, the court “abused its discretion” in allowing a number of pieces of evidence to be admitted — such as the list of extra weapons found in Hosier’s car, apartment and storage unit — unfairly swaying the jury.

    Replying for the state, Assistant Attorney General Gregory L. Barnes’ 120-page brief said Hosier originally didn’t list an objection to the cell phone “ping” — but, in any event, he didn’t have a legal right to object because he “had no reasonable expectation of privacy in his location along public thoroughfares or in the cell location data with a cell phone that he voluntarily purchased and chose to accompany him emitted as a proxy for that location.”

    Barnes said police had presented enough information in its warrant applications to show “probable cause” for the search warrants.

    And Hosier’s absence the morning of the murders was “evidence of flight and consciousness of guilt,” the state argues.

    Additionally, Hosier’s argument that the Oklahoma troopers had no reason to stop Hosier disappeared because “he fled from the Oklahoma police when they activated their lights and siren.”
