    Jury selection began Tuesday for Gary Kleypas, the man convicted of killing Pittsburg State student Carrie Williams in 1996.

    Police found Williams body beaten and stabbed in her apartment.

    The original jury sentenced Kleypas to die on March 11, 1998, but in 2004 the Kansas Supreme Court ruled capital punishment unconstitutional.

    Kleypas then joined other convicts in a wait to be re-sentenced.

    Last year the U.S. Supreme Court decided the Kansas death penalty is constitutional.

    The new jury will deliberate on a punishment for Gary Kleypas.

    The trial is slated to begin Monday, September 8.

    GIRARD, Kan. - A judge upholds a second death sentence for a man who raped and murdered a Pittsburg State University student more than 12 years ago.

    A jury in September recommended that 52-year-old Gary Kleypas be given the death penalty for the March 1996 slaying of 20-year-old student Carrie Williams in her apartment. On Wednesday afternoon, a Crawford County judge upheld that sentence.

    It's the second time Kleypas has been sentenced to death since being convicted of capital murder in 1997. The Kansas Supreme Court overturned his first death sentence in December 2001, concluding the law did not give jurors enough guidance to determine when to impose capital punishment.

    At the time of Williams' death, Kleypas was on parole for a 1977 murder in Missouri.

    Oral arguments in Kleypas appeal next week

    The Kansas Supreme Court will hear oral arguments in Gary Kleypas's appeal case. Those arguments are set to begin Monday, December 14 at 9:00 am.

    Kleypas was convicted of capital murder, attempted rape and aggravated burglary in the death of a Pittsburg State University student in March of 1996.

    He was sentenced to death. His case was the 1st court challenge under the death penalty bill enacted by Kansas lawmakers in 1994.

    This is the 3rd appeal in the case.

    In a 2001 decision, the Supreme Court returned the case to the Crawford County District Court with instructions to conduct another penalty phase hearing in which a jury decides whether to impose the death penalty.

    In a 2006 appeal by the state, the court settled an evidentiary issue prior to the penalty phase rehearing. In this appeal, Kleypas again argues his convictions should be reversed but focuses most of his arguments on 14 issues regarding alleged errors during the penalty phase hearing. He seeks reversal of his death sentence because of these errors.

    In one of the 14 penalty phase issues, Kleypas argues that the trial court should have stopped the hearing after the victim's father attacked him in front of the jury because the attack prejudiced the jury against him. He also argues the trial court should not have allowed evidence that he had been convicted of murder in Missouri in 1977 because ineffective defense counsel made the conviction suspect. And, he argues the prosecutor improperly told the jury that it could not consider mercy in deciding whether to sentence Kleypas to death.

    TOPEKA, Kan. (AP) — A man condemned to death for the 1996 rape and killing of a southeast Kansas college student again is asking the state’s highest court to throw out his sentence.

    The Kansas Supreme Court heard two hours of arguments Monday morning involving 60-year-old Gary Kleypas’ appeal.

    Kleypas was convicted of attacking and killing 20-year-old Pittsburg State University student Carrie Williams in 1996. He became the state’s first person condemned to die in more than three decades.

    After the state Supreme Court in 2001 overturned Kleypas’ death sentence, another jury restored it in 2008.

    At the time of Williams’ death, Kleypas was on parole for a 1977 murder in Missouri.

    The Kansas Supreme Court last month upheld a death sentence for the first time since the state reinstated capital punishment in 1994.

    TOPEKA, Kan. — The Kansas Supreme Court on Friday upheld the death sentence of Gary Kleypas, who raped and murdered a Pittsburg State University student at her home in 1996.

    Kleypas, Kansas’ first death row inmate, had to be tried twice for the rape, torture and murder of 20-year-old Carrie Williams in March 1996. His first capital murder conviction and death sentence was overturned by the Supreme Court in 2001.

    Jurors handed down a second death sentence in 2008 after he was retried.

    In a 166-page decision released Friday, the court said it found several errors – one of which required reversal of an attempted rape conviction – but that none warranted vacating Kleypas’ capital murder conviction or death sentence.

    Friday’s ruling was written by Justice Marla Luckert. She is one of five Supreme Court justices seeking retention on Nov. 8.

    Justice Lee Johnson dissented, saying the death penalty violated Kansas Constitution’s prohibition against cruel and unusual punishment.

    The decision marks the third death sentence upheld by the court over the past year. It also has affirmed death sentences for Johnson County serial killer John Robinson Jr. – known for storing his victims’ bodies in barrels – and for Scott Cheever, who fatally shot Greenwood County Sheriff Matt Samuels during a drug raid in 2005.

    What a coincidence that the Court finally started affirming death sentences when 5 of the members are up for retention in the November election.

    Hopefully the people in Kansas will see through this charade and remove them like California's voters did to the Bird court many years ago.

    Death sentence upheld in southeast Kansas murder

    The Kansas attorney general's office says the U.S. Supreme Court has declined to review the case of a man convicted in the murder of a Pittsburg State University student.

    Gary Kleypas was convicted in the 1996 murder of 20-year-old Carrie Williams. He was convicted in 1997 in Crawford County district court, and the Kansas Supreme Court later affirmed the capital murder conviction but overturned the death sentence. Kleypas was sentenced to death by a new jury in 2008, and the state supreme court upheld that sentence in a ruling last fall.

    The denial by the U.S. Supreme Court means that the conviction and death sentence will stand for Kleypas, who is now 61. The case will now be returned to the Kansas courts for further proceedings under the state's death penalty statute, and although this is the end of direct appeals, Kleypas will have options to ask for further judicial review.

    Kleypas is one of ten people who are facing a death sentence in Kansas.
