    Bobby Batiste - Mississippi Death Row



    Facts of the Crime:

    Bobby Batiste, a former Mississippi State University student, was convicted and sentenced to death in the capital murder of his roommate, 28-year-old Andreas Galanis. Batiste was accused of killing Galanis by blunt-force trauma to the head after they got into a fight on March 7, 2008, in their off-campus apartment when Galanis discovered money missing from his checking account.

    He suspected Batiste had used his debit card without his permission. Batiste told police Galanis attacked him first, but evidence at the trial refuted that. The Oktibbeha County jury of eight men and four women deliberated for three hours before returning its decision. Family members of victim Andreas Galanis were in tears after Circuit Court Clerk Angie McGinniss announced Batiste’s sentence.

    Batiste was sentenced to death on October 31, 2009.

    Death Penalty Handed Down In Oktibbeha County Capital Murder Trial

    An Oktibbeha County county jury has given Bobby Batiste the death penalty.

    The 29 year-old was found guilty of capital murder, in the death of his roommate Aundreas Galanis, Friday afternoon.

    In a trial that lasted only three days, prosecutors showed jurors video of Batiste admitting to deputies he beat Galanis to death after an argument, but Batiste's lawyers argued it was self defense.

    Defense lawyers called nine witnesses, including Batiste's mother, today hoping the jury would spare his life.

    Galanis' mother also took the stand, telling jurors how much her son will be missed.

    The jury took more than three hours before returning with the death penalty.

    Now family and friends of the victim say they can find closure.

    "I have closer (idea) of what happened to Aundreas. You just have to move on, we move on one step at a time, he's in a better place, he's our angle now watching down over us, he didn't deserve what happened to him," says family friend Mathew Sfirakis

    "I meant what I said in that closing argument. This isn't something you you do very lightly. I believe in the death penalty, I think it's appropriate, I think it's a deterrent, and I think it's important, but it's still an emotional and mentally draining thing to do," says District Attorney Forrest Allgood.

    Batiste's lawyers tell WCBI they plan to appeal the decision.

    The Mississippi Supreme Court will hear oral arguments Wednesday in an appeal from death row inmate Bobby Batiste.

    Batiste, a former Mississippi State University student, was sentenced to death in 2009 for killing his roommate.

    Batiste was convicted of capital murder in Oktibbeha County in the March 2008 death of 28-year-old Andreas Galanis.

    Prosecutors say Galanis died from a blow to the head after the two got into a fight at their off-campus apartment.

    The fight began when Galanis discovered money missing from his checking account, prosecutors said. Batiste told police Galanis attacked him first, according to court records.

    Lawyers for Batiste will ask the Supreme Court to consider his claim of self-defense.

    The Mississippi Supreme Court upheld the conviction and death sentence handed down in an Oktibbeha County case.

    Bobby Batiste, 33, is on death row for the 2008 robbery and beating death of Andreas Galanis, 28, of Biloxi.

    The men were roommates at an apartment complex in Starkville while students at Mississippi State.

    Among the 15 complaints Batiste filed in an attempt to have the case overturned, he claims the judge never allowed the jury to hear his side of the case.

    His attorney says evidence of the theft of Galanis's wallet occured so long after the man's death it shouldn't have been used to support the capital murder conviction.

    Justices upheld his conviction Tuesday on a 6 to 3 decision.

    Mississippi death row inmate Bobby Batiste has asked the U.S. Supreme Court to hear his appeal.

    Prosecutors have until Feb. 3 to file a response to Batiste's motion.

    The Mississippi Supreme Court upheld Batiste's conviction and death sentence in May.

    Robbery was a key element required for an Oktibbeha County jury to convict him of capital murder and sentence him to death.

    In today's United States Supreme Court orders, Batiste's petition for writ of certiorari and motion for leave to proceed in forma pauperis was DENIED.

    Inmate Loses Effort to Seal Medical Records

    The Mississippi Supreme Court has denied a motion from death row inmate Bobby Batiste to seal his medical records.

    Batiste's attorneys argued the medical records contain sensitive, personal information about Batiste's medical condition, mental state and diagnosis. They argue the public disclosure of the records would substantially harm to Batiste's right to privacy.

    In a 7-2 order Thursday, the Supreme Court said Batiste raised the issue of his health in seeking to overturn his death sentence. The court said by going so, Batiste waived any medical privilege to keeping the records secret.

    Batiste, now 35, was convicted of capital murder and sentenced to death in 2009 in the death of 28-year-old Andreas Galanis. Authorities say Galanis died after the two got into a fight in 2008 in their Starkville apartment.

    Mississippi death row inmate claims medical condition would worsen pain of execution

    A Mississippi death row inmate is arguing to the state Supreme Court that his medical condition would create a risk of unnecessary pain and torture if he is executed.

    Bobby Batiste is asking the Supreme Court to order an Oktibbeha County judge to conduct a hearing on his medical arguments. Batiste wants to be resentenced to life in prison.

    Batiste's appeal is among dozens the Supreme Court will consider during its September-October term. The court will not hear oral arguments in the case.

    Batiste, now 35, was convicted of capital murder and sentenced to death in 2009 in the slaying of 28-year-old Andreas Galanis.

    Authorities said Galanis died of head injuries after the two roommates got into a fight March 7, 2008, in their Starkville apartment when Galanis discovered thousands of dollars missing from his checking account. He suspected Batiste had used his debit card without his permission.

    Batiste told police that Galanis attacked him first, but prosecutors argued that the evidence showed it was murder.

    The U.S. Supreme Court declined in 2014 to hear an appeal from Batiste.

    In June, the Mississippi Supreme Court refused to seal Batiste's medical records. Batiste's attorneys argued the records contain sensitive, personal information about Batiste's medical condition, mental state and diagnosis. They argued the public disclosure of the records would substantially harm Batiste's right to privacy. The records would be available to prosecutors and the court.

    Batiste said he suffers from large thrombosed, or clotted, varicose veins. The issue of Batiste's health arose when he was taken to the hospital in March and was diagnosed with the condition.

    The Mississippi Supreme Court ruled because Batiste had placed his medical condition in issue, he has waived any medical privacy arguments.

    In another case, the Supreme Court will hear a post-conviction appeal from James Robert Rowsey, who was convicted of murder and sentenced to life in prison for the 1995 killing of his mother.

    Rowsey was convicted of shooting his mother, Jeanette, to death on April 7, 1995, on their family farm in Panola County.

    Rowsey testified they argued and struggled. He said he put a round into the chamber of the gun to get his mother's attention.

    Rowsey claimed that as his mother was reaching for his elbow he pulled his arm back and the gun went off. His mother died from a gunshot wound to the chest.
