State seeking death penalty in teen girl’s slaying

The state is seeking the death penalty this week in the capital murder of a 17-year-old girl as prosecutors try to prove Leslie Galloway III sexually assaulted her, set her on fire and ran over her with a car in 2008.

Galloway, 27, of Moss Point, is on trial in the slaying of Shakeylia Anderson. She was a senior at Harrison Central and a member of the ROTC.

A sequestered jury was seated Tuesday and heard the state’s opening argument behind closed doors as dozens waited outside the courtroom for security checks with handheld metal detectors at the Harrison County Courthouse in Gulfport.

Circuit Judge Roger Clark allowed the courtroom doors to be opened before witness testimony began. Anderson’s family and friends packed one side of the courtroom, and local criminal-justice students filled the other side. The judge warned them not to enter or leave the courtroom during testimony.

Anderson was last seen alive leaving her grandmother’s home the night of Dec. 5, 2008. A younger cousin, 15 at the time, testified she stood at the glass storm door in the Turnkey neighborhood, also known as Forest Heights, and watched Anderson leave with a man in a white Ford Taurus.

The next night Martin Smith of Biloxi was running fox-hunting dogs with friends off Mississippi 15. Smith said he went looking for one of his dogs and found a “very red, unclothed dead person” on a logging trail.

Harrison County Sheriff’s Sgt. Mechelle Carbine said the temperature was in the mid-30s and investigators had to wait until daylight to collect evidence.

“Mangled is the best word I can use to describe the body,” Carbine said.

Assistant District Attorney George Huffman showed the jury a poster-size picture of the body, found about 200 yards from a patch of burned grass.

Carbine said broken glass found near the burned grass came from the bottle of a certain brand of gin, the same brand later found in Galloway’s bedroom.

Galloway, in a taped interview played Tuesday, admitted he had been with Anderson and had driven his mother’s white Ford Taurus, but he did not talk about Anderson’s death.

Detectives found the imprint of tire tread and a tire model number on Anderson’s leg, as well as evidence of a pedestrian accident under the Ford Taurus.

Alan Graham, Anderson’s uncle, described her as “beautiful, healthy and fun-loving.”

“She wanted to join the Air Force,” he said.

It’s unclear if public defenders will use some of Galloway’s previous statements in his defense. They waived the right to give an opening statement until after the prosecution presents its case.

In a hearing in January, Carbine said Galloway had later claimed two men with shaved heads and a red truck forced him and Anderson to leave a Gulfport park with them and one of the men ran over Anderson with the Ford Taurus.

    Galloway guilty of "gruesome" murder

GULFPORT, MS (WLOX) - A jury took less than two hours to determine Leslie Galloway III was guilty of capital murder in the gruesome death of a 17-year-old Harrison Central High School student.

Jurors will return to the Harrison County courtroom at 3:30 Thursday afternoon. At that time, they'll begin listening to testimony that will ultimately help them determine if Galloway should receive the death penalty. Prosecutors say the sentencing phase of this trial won't conclude until Friday, because a defense witness can't be in court until then.

Jurors found Galloway guilty of raping Shakeylia Anderson in December, 2008. He then cut her throat, set her on fire, and then ran over her with a car. One investigator called it the most gruesome crime scene she ever witnessed.

The victim was a student at Harrison Central High School. Her body was discovered by hunters in the Desoto National Forest several days after she died.

Expert witnesses said traces of her remains were found under a Ford Taurus belonging to the defendant's mother.

During closing arguments Thursday morning, defense attorney Charlie Stewart said the state showed the vehicle was involved, but had not proved Galloway was the person driving.

"There is somebody else involved and the state is trying to hide that from you," said Stewart.

Prosecutor George Huffman reminded the jury that Galloway admitted to picking Anderson up that night and a witness saw the girl get into the car with him.

"The ultimate fact is that on December 6, 2008 Leslie Galloway beat, brutally raped and cut the throat of 17-year-old high school student Shakeylia Anderson,"said Huffman.

Jury sends Galloway to death row

GULFPORT, MS (WLOX) – A jury has determined that Leslie Galloway III deserves the death penalty for raping, burning, and running over a 17 year old Harrison Central High School student.

Just before 2:00 pm today, jurors returned to the Harrison County courtroom. They spent about two hours deliberating a sentence for the convicted capital murderer. Yesterday, the same jury determined that the Moss Point man was guilty of the December, 2008 murder of Shakeylia Anderson.

Prosecutors convinced a jury that Leslie Galloway used his mother's car to drag Shakeylia Anderson after he had raped her, cut her throat, and set her on fire. It wasn't until the murder trial that Shakeylia's mother found out about her last moments.

"It's been hard," Sandra Anderson said. "I knew she suffered, but I didn't know she went through all she did."

The Anderson family's nearly two year wait for justice ended when jurors convicted Galloway of capital murder after two hours of deliberations.

"It was overwhelming. It was joyful," said Shakeylia's father, Jerry Anderson. "They came out with the right verdict. The verdict that I was looking for."

    Tawonna Pope is Shakeylia's cousin.

"I'm just so happy that we got the verdict that we got, because justice was served. He got what he deserved, because she didn't deserve what she got. What he got, I'm just extremely happy, brought tears to all our eyes."

There were also tears of anguish shed at the Harrison County courthouse. Leslie Galloway's mother was not in the courtroom when the verdict came in, but she said she plans to testify during his sentencing phase.

She talked with WLOX off camera about her worst fears.

"I don't know what happened that night," Ollie Varghese said. "My son is not a monster. I just don't want him to get the death penalty. That's my baby. Both families are hurting behind this. If I could bring her back, I would."

But no one can bring Shakeylia back, and the girl's mother said the man who took her daughter's life deserves to die.

"I haven't been able to sleep and I still won't be able to sleep until his eyes are closed," Sandra Anderson said.

A witness testified she saw Shakeylia get into a car Leslie Galloway was driving the night of her murder. Galloway also admitted to police that he had picked her up. Traces of Shakeylia's remains were found under the car.

    Galloway v. Mississippi

    Opinion Date: June 6, 2013

    Court: Mississippi Supreme Court

Leslie "Bo" Galloway was convicted and sentenced to death by lethal injection for the murder of Shakeylia Anderson. Galloway appealed to the Supreme Court, listing thirty evidentiary and procedural errors, and that he received ineffective assistance of trial counsel. In an one-hundred page opinion, the Supreme Court took each in turn and ultimately concluded that all of Galloway's arguments were without merit.

Supreme Court denies death penalty rehearing in Harrison County teen's killing

The Mississippi Supreme Court has denied a request to rehear the death penalty case of Leslie "Bo" Galloway III, convicted of raping and killing a Harrison Central High senior in 2008.

The Supreme Court in June upheld Galloway's 2010 conviction and death sentence in the slaying of Shakeylia Anderson, whose body was found in woods off Mississippi 15 on Dec. 6, 2008.

Galloway, now 30, is from Moss Point.

A Harrison County jury heard testimony that Anderson was sexually assaulted, set afire and run over by the car Galloway had picked her up in the night before she was found. A tire left its imprint on her leg, and she was beaten, her jaw broken and her throat cut three times.

The jury deliberated a little more than two hours before finding Galloway guilty and deliberated about the same amount of time on the death penalty in the sentencing phase of the trial

A legal defense team's motion for a rehearing said the trial court erred on several points of law and said Galloway would not have been eligible for the death penalty had it not been for a forensic pathologist's testimony about Anderson's sexual assault.

Capital murder is a killing committed during the act of another felony.

Defense attorneys provided the high court a document with observations from out-of-state forensic pathologists. The document said the pathologist who testified gave his opinion but did not mention scientific principles or methodology.

The Supreme Court denied the motion without comment.

The capital murder case was one of only two in six years in which a Harrison County jury in Gulfport imposed the death sentence. Only a jury can decide on the death penalty. Without that decision, a capital murder conviction is punishable by life without parole.
