    Court denies rehearing in death row appeal

    JACKSON, Miss. (WTVA) -- A Blue Mountain man will remain on death row in the shooting death of a newspaper delivery man.

    Marlon Howell, 34, faces the death penalty in the shooting death of David Pernell, 61, of New Albany in May of 2000.

    Last year, a judge denied a request for a new trial after holding an evidentiary hearing on Howell's post-conviction relief petition.

    Howell claims a witness recanted his identification, another witness was not allowed to testify in his defense, and he did not have an attorney during the lineup.

    In October, the Mississippi Supreme Court upheld the judge's ruling not to grant a new trial.

    On Thursday, justices denied a request to rehear the appeal.

    State's highest court denies appeal in capital murder case

    The Mississippi Supreme Court has denied the motions of a man on death row.

    Marlon Howell, 36, was convicted of capital murder in the May 2000 death of David Pernell in New Albany.

    Howell had filed a motion last year to allow him to present new evidence to the trial judge he says would clear him.

    The evidence was testimony from a woman who claims to have given Howell a ride from New Albany to Blue Mountain around 1 a.m. on the morning of Pernell's death.

    She says they returned to Blue Mountain around 5 a.m., the time Pernell was shot while on a newspaper delivery route.

    The woman's mother had told investigators her daughter arrived back home around 3 or 4 a.m.

    The state's highest court denied the motion Thursday saying the petition was not filed within legal deadlines.

    They also say Howell provided no new information or witnesses that weren't known at the time of his original trial.
