    Summary of Offense:

    In 1994, Moffett raped and killed five-year-old Felicia Griffin. He was dating Griffin’s mother at the time. Moffett was initially charged with the murder, but was released when no forensic evidence was found. The case was reopened in 2002 because of advancements in DNA evidence. Moffett said that he returned home to find Griffin bleeding in the master bedroom. He claimed that she was killed by an intruder.

    Miss. death row inmate loses appeal

    The Mississippi Supreme Court has rejected arguments Eric Moffett was denied a fair trial when a judge refused to let his lawyers tell a jury that someone else could've killed the 5-year-old daughter of Moffett's girlfriend in 1994.

    The Supreme Court on Thursday upheld Moffett's capital murder conviction and death sentence handed down in 2006 in Hinds County in the death of Felicia Griffin.

    According to court records, Moffett claimed Felicia was killed by an unidentified intruder.

    He told authorities that he returned home from a bar and found the girl bleeding.

    The Supreme Court said there was no evidence to support Moffett's claim that someone else was seen in the neighborhood at the time the child was raped and strangled.

    In today's United States Supreme Court orders, Moffett's petition for a writ of certiorari and motion for leave to proceed in forma pauperis were DENIED.

    The U.S. Supreme Court has declined to hear an appeal from Eric Moffett, a Mississippi death row inmate who has argued that he was denied a fair trial when a judge refused to let his lawyers tell a jury that someone else could've killed the 5-year-old daughter of Moffett's girlfriend in 1994.

    The Mississippi Supreme Court says it will not consider death row inmate Eric Moffett's post-conviction petition until a Hinds County judge rules on his request for a mental evaluation.

    In an order this past week, the Supreme Court says Moffett raised the mental disability issue in his post-conviction petition. The court says the petition will be put aside until the trial judge rules.

    Moffett's capital murder conviction and death sentence were upheld in 2010 by the Supreme Court. He was convicted in 2006 in Hinds County in the death of 5-year-old Felicia Griffin. The child was his girlfriend's daughter.

    The Mississippi Supreme Court has denied the post-conviction arguments of death row inmate Eric Moffett.

    Moffett's capital murder conviction and death sentence were upheld in 2010 by the Supreme Court. He was convicted in 2006 in Hinds County in the death of 5-year-old Felicia Griffin. The child was his girlfriend's daughter.

    In his post-conviction petition, Moffett argued he deserved a new trial because of his lawyers' poor performance during his trial and his sentencing.

    The Supreme Court ruled Thursday the given the overwhelming evidence of Moffett's guilt, there has been no miscarriage of justice and Moffett failed to show how his lawyers did a poor job.

    The court also said Moffett was using the issue of ineffective counsel to reargue evidence used in the sentencing phase of his trial.
