    Michael Menchaca Sentenced to LWOP in 2010 TX Death of 4 yr-old

    Seguin Man Charged In Child's Death

    A man is in the Guadalupe County jail charged in the death of his 4-year-old stepson. 29-year-old Michael J. Menchaca is charged with capital murder in the death of a person under six years of age.

    He's also charged with injury to a child and tampering or fabricating physical evidence with intent to impair the investigation. His bonds add up to one million 550 thousand dollars.

    According to the Seguin Gazette Enterprise, the death stems from an injury in the family's home Friday. The boy was flown to University Hospital with a fracture to the back of his skull.

    Menchaca reportedly told authorities the boy had fallen in the shower. If convicted, Menchaca faces the death penalty or life in prison without parole.

    The Seguin Gazette reports that, despite the option to take his case to trial and let a jury decide his fate, a Seguin man decided to plead guilty to capital murder charges, sending him to prison for the rest of his life. 30-year old Michael Jason Menchaca was accused of killing his girlfriend’s 4-year old son, and had originally intended to take his case to a jury, with testimony set to begin yesterday. But in a surprise move, Menchaca’s lawyers told the court that he had decided instead to plead guilty. The DA’s Office had not put a deal on the table, and the judge said that because the case was a capital murder case, the sentence would be life in prison without parole. After making sure Menchaca understood that he was giving up the possibility that a jury might find him not guilty, or guilty of a lesser crime (like manslaughter) the judge accepted his guilty plea and sentenced him to the maximum jail sentence (since the death penalty had already been taken off the table).
