    Summary of Offense:

    Convicted and sentenced to death for killing a Biloxi convenience store owner in 2007. Keller was convicted of robbing and killing 41-year-old Hat Nguyen. During closing arguments of the sentencing phase, Assistant District Attorney Scott Lusk told jurors that Keller had wanted to know what it felt like to kill someone. Keller apologized to his victim’s family and said he would pray for them. Keller had testified he was high on cocaine when he robbed and shot Nguyen four times. Prosecutors say the capital murder conviction was his sixth felony conviction.

    Keller was sentenced to death in Harrison County on October 8, 2009.

    Murderer gets death penalty Jury deliberated five hours on sentence

    BILOXI — Jason Lee Keller nodded his head in acknowledgment Thursday as a jury imposed the death penalty for the capital murder of 41-year-old Hat Nguyen.

    Circuit Judge Lisa Dodson allowed Keller, 30, to apologize to the family of Nguyen, a single mother of four who worked seven days a week at Popp’s Ferry Road Food Mart.

    “I am very sorry,” Keller said. “There’s nothing I can do to change what I did. Every day and every night, y’all are in my prayers.”

    It took the jury 30 minutes Wednesday to find him guilty of the fatal shooting and robbery on June 21, 2007. The jury, sequestered all week, deliberated five hours Thursday in the sentencing phase.

    Only a jury can impose the death penalty. It’s the first time in five years that a Harrison County jury has given the death penalty.

    David Nguyen, one of the victim’s sons, said it’s hard to be happy about resolution of the case because of the death penalty.

    “This has been hard, not just for us,” Nguyen said.

    The Nguyens lost their home in Hurricane Katrina and lived in the back of the store. The youngest child was asleep when Hat Nguyen was killed.

    In closing arguments, Assistant District Attorney Scott Lusk told the jury, “her killing was a brutal, heinous and vicious killing. He (Keller) does not deserve any consideration from you for life without parole.”

    The penalty for capital murder is death or life without parole.

    Keller already is serving life without parole for the armed robbery of a Hancock Bank in Lyman. The bank heist occurred six months before Nguyen was killed. He was convicted of the bank heist in December 2007 and was sentenced as an habitual offender because of prior felony convictions.

    In an interview with Biloxi police, Keller admitted he shot and robbed Nguyen but said he didn’t mean for the bullets to strike her.

    Nguyen was shot four times. The final shot, to the back of her head, was fatal. A forensic pathologist testified she was still alive as she crouched or knelt behind the store counter before the final shot.

    Soon after, bank surveillance cameras filmed Keller exchanging $175 in rolls of coins for cash. Keller later told police he used the money to buy crack cocaine.

    Police found Keller driving a stolen pickup on Interstate 10.

    Public defender Lisa Collums asked the jury to spare Keller’s life.

    “Is he so far gone there’s no hope at all for him in life?” Collums asked. “He has been a good inmate. He has shown he can conform to rules. He is never getting out of prison — never.”

    Keller’s father sat quietly as the sentence was read and declined comment.

    Public defenders said they will begin the paperwork to appeal the death sentence.

    Death penalty case before Miss. court

    JACKSON, Miss. (AP) - The Mississippi Supreme Court is scheduled to hear an appeal Monday from death row inmate Jason Lee Keller, who wants a new trial in the 2007 robbery and shooting death of a woman in Harrison County.

    Prosecutors say 41-year-old Hat Nguyen, a single mother of 4, was killed at the convenience store she owned in Harrison County.

    Court records show the Nguyen family lost their home to Hurricane Katrina in 2005 and lived in the back of the store.

    Prosecutors say Keller, now 33, allegedly shot Nguyen shot four times. A shot to the back of her head was fatal.

    Keller was convicted in Harrison County Circuit Court in 2009.

    Court records show Keller told investigation that he was high on cocaine when the incident occurred.

    Supreme Court orders hearing for death-row inmate from Biloxi killing

    The Mississippi Supreme Court has ordered a hearing to determine if the rights of death-row inmate Jason Lee Keller were violated by a statement he made to police while he was recovering from gunshot wounds in a hospital.

    Keller was convicted in the 2007 capital murder of Hat Nguyen, a 41-year-old single mother of four who worked at a convenience store in Biloxi.

    He has appealed his conviction, but the order handed down Friday does not grant him a new trial. An evidentiary hearing on a statement offered into evidence at his trial will be reviewed before the state's high court makes a decision.

    Keller gave police three different statements, but two of them were excluded from his trial. The statement that was allowed to be presented in court is the statement in question.

    Keller claims his statements were coerced and were used to gain more information from him.

    The Mississippi Supreme Court has upheld the capital murder conviction of Jason Lee Keller, found guilty of robbing and killing Hat Nguyen, a 41-year-old Biloxi store clerk.

    The decision was handed down Thursday in a 108-page document.

    Nugyen, whose family lost their home in Hurricane Katrina, lived in the back of Popp's Ferry Road Food Mart. She was shot four times on June 21, 2007, while her youngest child was asleep in the back of the store.

    A Harrison County jury convicted Keller in October 2009 and imposed the death penalty.

    Keller is 34.

    The Supreme Court upheld Keller's conviction in February. On Thursday, it denied Keller's petition to look at his appeal again.

    The U.S. Supreme Court will decide Feb. 20 whether to hear an appeal from a Mississippi death row inmate.

    Court officials say a decision could be announced shortly after the court conference.
