    Heck Van Tran - Tennessee Death Row




    Facts of the Crime:

    Sentenced to death on August 28, 1989 after he was convicted of three counts of felony murder for his role in an October 20, 1987 triple murder during a robbery at a Memphis restaurant. The victims were Arthur Lee, 24; his grandmother, Kai Ying Chuey, 70; and Lee's sister-in-law, Man Yin Huang "Amy" Lee, 23.

    On July 20, 2011, Tran filed an appeal in the US Sixth Circuit Court of Appeals over the denial of his habeas petition in Federal District Court.

    Heck Van Tran v. Roland Colson

    In today's Sixth Circuit Court of Appeals opinions, the court ruled that the state court’s application of Tennessee law with regard to whether Van Tran is intellectually disabled under Atkins was contrary to clearly established federal law. Accordingly, we VACATE and REMAND to the district court so that the district court may grant a CONDITIONAL WRIT OF HABEAS CORPUS prohibiting execution unless the State completes a new Atkins hearing consistent with this opinion.

    TDOC: Inmate assaulted officer with hot water

    The Tennessee Department of Correction is reviewing its security measures after they say a death row inmate assaulted an officer with hot water.

    The officer was treated by medics after the incident on Wednesday night at Riverbend Maximum Security Institution.

    The inmate, Heck Van Tran, was convicted of three counts of murder during a robbery at a Memphis restaurant.

    He's been on death row since 1989.

    I'm really surprised that Born to Kill isn't mentioned at all in this guys records. He fits every hallmark of their gang but preceded their expansion by a couple of years. Even the robbery went wrong as BTK's always did. He was also active exactly where they were recruiting in 89 and 90.
