    Death Row Inmate Nickolus Johnson Granted Stay

    A death row inmate who was scheduled to die later this month has been given a stay of execution.

    According to the Tennessee Administrative Office of the Courts, Nickolus Johnson was granted post-conviction relief last month.

    The 35-year-old, who has been on death row since 2007, was to be put to death on April 22 for killing a Bristol police officer in 2004.

    The last inmate executed in the state was Cecil Johnson on Dec. 2, 2009.

    There are 76 inmates on Tennessee's death row, including one woman.

    Convicted cop killer asks for new trial

    BLOUNTVILLE, Tenn. — Convicted cop killer Nikolaus Johnson is asking for a new trial based on a host of claims ranging from ineffective legal representation, prosecutorial conflict of interest and misconduct and juror bias to racism and severe mental and physical illnesses.

    A 162-page amended petition for post-conviction relief was filed April 9 in Sullivan County Circuit Court and asks that his convictions and sentences be vacated. Johnson says his constitutional rights were violated during the trial and sentencing phases.

    Johnson was convicted in 2007 of the 2004 shooting death of Bristol Tennessee Police Officer Mark Vance. Vance was responding to a domestic violence call when he was shot in the face.

    Johnson was convicted of first-degree murder and sentenced to death. An execution was set for April 2014, but he was granted a stay of execution.

    In the petition, Johnson claims that his defense attorneys were ineffective at trial and during sentencing. He claims they failed to investigate him and his case and failed to present relevant evidence.

    Johnson also claims he has diagnosed medical disorders, including schizophrenia, bipolar disorder and medical diseases including Crohn’s disease, Tourette syndrome and persistent hiccups that affected his sleep.

    In addition, Johnson claims that his severe mental illness exempts him from the death penalty and that the death penalty is unconstitutional.

    The petition also claims misconduct by prosecutors, who Johnson claims improperly obtained pledges from prospective jurors to sentence him to death. He also accuses prosecutors of misleading testimony, intimidation of jurors and conflict of interest.

    District Attorney General Barry Staubus said that since Johnson claims his office has a conflict of interest, a hearing will be held June 23 to determine if that’s the case.

    “If the judge determines there is a conflict of interest then my office would no longer be able to be involved in the litigation,” he said. “If the judge determines there is no conflict of interest then we go forward.”

    Johnson also claims that jurors were biased and he accuses them of misconduct.

    Convicted cop killer seeks post conviction relief, recusal of prosecutor

    BLOUNTVILLE, Tenn. — A judge will decide in September whether to recuse the Sullivan County District Attorney’s office in the case against convicted cop killer Nikolaus Johnson.

    Johnson was convicted in 2007 and sentenced to death in the 2004 murder of Bristol Tennessee Police Officer Mark Vance. Officials said Vance was responding to a domestic violence call when Johnson shot him in the face.

    The man had been sentenced to death, but the state gave him a stay of execution in 2014.

    Johnson has filed a couple motions, including one to recuse District Attorney Barry Staubus, and another for post-conviction relief. The 150-page motion mentions several issues regarding the trial.

    Sullivan County Circuit Court Judge Jerry Beck is expected to make a decision Sept. 29 regarding the request to recuse the DA’s office.

    D.A.’s Office removed from case of man on death row for murdering a Bristol police officer

    SULLIVAN COUNTY, TN – The Second Judicial District Attorney’s Office in Sullivan County can no longer serve as the prosecuting attorneys in the case of a man on death row for the murder a police officer more than a decade ago.

    In late September, Nickolus Johnson’s attorneys argued before a judge to get District Attorney General Barry Staubus, his office, and his predecessor Greeley Wells removed from the case as it moves forward to a post-conviction hearing.

    In 2004, police charged Johnson with first-degree murder in the death of Bristol Tennessee police officer Mark Vance. Johnson was sentenced to death in 2007.

    Johnson’s attorneys said the D.A.’s office looked at sealed records that they weren’t allowed to look at after the trial.

    Staubus said his office is deciding what its next move will be.
