    Donald Ray Middlebrooks - Tennessee Death Row




    Facts of the Crime:

    On April 26, 1987, Middlebrooks, 24 at the time of the crime, his wife, Tammy Middlebrooks, 17, and a friend, Roger Brewington, 16, chased the victim and his friends from a makeshift flea market in Nashville. They grabbed Majors, knocked him down and dragged him into a wooded area. The victim, who was 4'11" tall and weighed 112 pounds, was tortured for several hours. An “X” was carved into his chest, he was forced to drink urine, burned, raped with a stick, beaten with brass knuckles and stabbed to death. In a confession, Middlebrooks said the victim was crying and pleaded that he wanted to “go to school and get an education.” The defendants, who were white, also used racial epithets toward Majors, who was black.

    Middlebrooks was sentenced to death on September 22, 1989.

    On September 1, 2010, the US Sixth Circuit Court of Appeals denied Middlebrooks a Certificate of Appealabilty.

    On March 26, 2012, Middlebrooks was GRANTED his petition for a writ of certiorari. Judgment is vacated and the case is remanded to the Sixth Circuit re: Martinez v Ryan.

    On August 27, 2014, Middlebrooks filed an appeal before the US Court of Appeals for the Sixth Circuit.

    Case files: New appeals for Tennessee death row inmates

    Lawyers have filed motions in Tennessee courts on behalf of condemned inmates that present a new, and perhaps unexpected, course of attack on the death penalty: Citing the U.S. Supreme Court ruling legalizing same-sex marriage nationwide. The motions seek to re-open the condemned inmates' cases.

    They argue that the Supreme Court justices in the 2015 same-sex marriage case, known as Obergefell, ruled that courts cannot infringe on fundamental rights, including the right to life. The inmates say that to impose a death sentence infringes on that right.

    Many of those motions have been denied by judges, though a few are still pending.

    Here are some of those cases:

    Donald Middlebrooks, Davidson County, motion denied: Middlebrooks was convicted of torturing and murdering 14-year-old Kerrick Majors in 1987. The teen's naked body was found beaten, stabbed, choked, raped and with an "X" pattern on the chest under a mattress in a dry creek bed in East Nashville.

    In today's opinions, the Sixth Circuit Court of Appeals, the court AFFIRMED the district court's DENIAL of Middlebrooks' habeas corpus petition.

    Horrific crime. Is this guy done with his appeals? Hopefully, Tennessee can execute him next year.
