    Kennath Artez Henderson - Tennessee Death Row


    Deputy Tommy Bishop




    Facts of the Crime:

    Convicted in the May 2, 1997 murder of Deputy Tommy Bishop, by shooting through the back of the head at point-blank range. The deputy had not moved since first being shot in the neck moments earlier and was still lying face-down on the floor by the door to the treatment room when Henderson fatally shot him. Henderson was attempting escape during a dentist's office visit while incarcerated.

    Henderson was sentenced to death on July 13, 1998.

    On July 25, 2014, Henderson filed an appeal before the US Court of Appeals for the Sixth Circuit over the denial of his habeas petition in Federal District Court on May 8, 2014.

    Case files: New appeals for Tennessee death row inmates

    Lawyers have filed motions in Tennessee courts on behalf of condemned inmates that present a new, and perhaps unexpected, course of attack on the death penalty: Citing the U.S. Supreme Court ruling legalizing same-sex marriage nationwide. The motions seek to re-open the condemned inmates' cases.

    They argue that the Supreme Court justices in the 2015 same-sex marriage case, known as Obergefell, ruled that courts cannot infringe on fundamental rights, including the right to life. The inmates say that to impose a death sentence infringes on that right.

    Many of those motions have been denied by judges, though a few are still pending.

    Here are some of those cases:

    Kennath Henderson, Fayette County, motion pending: Henderson killed Fayette County Deputy Tommy Bishop, 43, by shooting him through the back of the head at point-blank range during an attempted escape from the Fayette County jail in 1997.
