    Gary Wayne Sutton - Tennessee Death Row




    Facts of the Crime:

    Convicted, along with James Dellinger, in the shooting death of Tommy Griffin and Connie Branam. Griffin, 24, was shot at close range with a shotgun, then his body was left alongside Little River in Townsend on February 21, 1992. The body was found on February 24. After an extensive investigation, Blount County authorities charged Sutton and Dellinger with Griffin's murder.

    Sutton was sentenced to death on September 3, 1996.

    On September 30, 2011, Sutton filed an appeal in the US Sixth Circuit Court of Appeals over the denial of his habeas petition in Federal District Court.

    In today's opinions, considering Martinez v. Ryan and Trevino v. Thaler, the Sixth Circuit Court of Appeals REMANDED Sutton's petition to the district court for further proceedings.

    On March 9, 2015, Sutton's habeas petition was DENIED on remand in Federal District Court.

    In today's Sixth Circuit Court of Appeals opinions, the court AFFIRMED the district court's DENIAL of Sutton's petition for a writ of habeas corpus filed under 28 U.S.C. § 2254 and his ineffective-assistance-of-counsel claim.

    In today's orders, the United States Supreme Court declined to review Sutton's petition for certiorari.

    Appeals exhausted decision could result in an execution date.
