    Facts of the Crime:

    James Hairston was found guilty by a Bannock County jury for the January 6, 1996 murder of William and Dalma Fuhriman in their home near Downey.

    According to Idaho Supreme Court documents, Hairston and a companion, Richard Klipfel, were traveling by car from Grand Junction, Colorado to Spokane, Washington. When they ran out of money on January 6, they stopped at the Fuhriman’s ranch home. The two travelers were invited into the house, where the Fuhrimans said they’d help them find jobs.

    While William was looking for a phone book, court documents say, Hairston shot him in the head, then shot his wife. Hairston and Klipfel took approximately $30 in cash, credit cards and some personal property from the home and continued their trip.

    Along the way, they used the credit cards to purchase food, tires, gas, lodging and remote control toy cars. They also tried to purchase a Harley Davidson motorcycle and $2,500 worth of snowboarding equipment, but the cards were declined. They were apprehended in Clarkston, Wash., three days after the murder.

    Klipfel was found guilty of two counts of being accessory to first-degree murder, and sentenced to 20 years for each. A robbery charge against Klipfel was dismissed.

    Hairston, on the other hand, was found guilty by a Bannock County jury and received a life sentence for the robbery — and two death sentences for the murders.

    On September 26, 2018, oral argument will be heard in Hairston's appeal before the Ninth Circuit. The panel will be made up of Judges Graber (Clinton), Rawlinson (Clinton) and Bybee (G.W. Bush).

    BOISE, Idaho (AP) — The Idaho Supreme Court has rejected the appeal of a man who says he was too young to be sent to death row after he killed two people at the age of 19.

    James Harvey Hairston was sentenced to death in 1996 in connection with the shooting deaths of an elderly couple. Prosecutors said William and Dalma Fuhriman, both 72, were killed during a burglary at their rural farmhouse.

    The Idaho Supreme Court unanimously rejected Hairston’s appeal on Monday, noting that while people under the age of 18 can’t be sentenced to capital punishment the U.S. has no such prohibition for older defendants.
