    Gene Francis Stuart - Idaho




    Facts of the Crime:

    Gene Stuart was convicted of murder by torture in 1982. His victim: three-year-old Robert Miller, the son of Stuart’s girlfriend Kathy Miller.

    Stuart, who was living with the child’s mother and had assumed a parental role, struck Robert in the abdomen when the child refused to eat his lunch. Later, Stuart found the boy having difficulty breathing and took him to the local hospital, where he was pronounced dead from internal hemorrhaging from a ruptured liver.

    Court documents state that Nick Albers, then sheriff of Clearwater County, was called out to the hospital on a possible child abuse case. Over the course of the investigation, Albers contacted several women from Stuart’s past, many of whom painted a picture of ongoing abuse and domestic violence.

    Kathy Miller testified against Stuart, but claimed she was not aware of the abuse. Experts testified they’d found evidence of earlier injuries inflicted upon the child — internal and external bruises, a subdural hematoma and on his head and a broken arm.

    After weeks of testimony, a jury found Stuart guilty — the first murder by torture conviction in the state of Idaho.

    Convicted Child Killer Ordered Off Idaho Death Row

    An Idaho man, sentenced to death more than 30 years ago for the murder of a 3-year-old, has been ordered off of Idaho's death row but will be spending the rest of his days behind bars.

    In 1981, prosecutors said Gene Stuart tortured 3-year-old Robert Miller, the son of Stuart's girlfriend, to death in her Orofino home. The child ultimately died from an abdominal punch that lacerated his liver. Stuart was sent to death row and had been scheduled for execution in 1983.

    Stuart, now 64, has spent more than 30 years appealing his death sentence on various grounds, including ineffective legal assistance. Now, this morning's Lewiston Tribune reports an agreement, two years in the making, has amended Stuart's conviction from first-degree murder to second-degree murder, reducing his death sentence to life in prison and requiring Stuart give up his right to any further appeals.

    The Tribune reports the Idaho attorney general's office would not comment on the matter, but a judgment from U.S. District Judge B. Lynn Winmill reads, "At this time, this case is considered closed."
