    Summary of Offense:

    On December 20, 2002, Cole was playing video games. He was interrupted by the crying of his nine-month-old daughter Brianna. He went to her crib and bent her legs backward and then flipped her over. This broke her spine and ruptured her aorta. He went back to playing video games, but eventually checked on Brianna, found her unresponsive, and called for emergency assistance. Cole had a conviction for abusing his infant son in California in 1987.

    Cole has been on death row since December 28, 2004.

    Cases like this do kind of make me wonder. I mean, for instance, states require that people take tests to get a license in order to drive a car, but absolutely everyone is allowed to have kids no matter what.

    Court Rejects Claremore Man's Appeal In Death Of Infant Daughter

    A federal appeals court has rejected the appeal of an Oklahoma death row inmate convicted in the death of his 9-month-old daughter.

    The 10th U.S. Circuit Court of Appeals took the action Monday in the case of 48-year-old Benjamin Cole of Claremore, who was convicted by a Rogers County jury of first-degree murder in the December 20, 2002, death of Brianna Cole.

    The state Medical Examiner's Office found that the baby's spine had been snapped in half and her aorta had been torn through.

    The appeals court's decision says Benjamin Cole told police he had caused the fatal injuries and acknowledged flipping the infant over because she would not stop crying.

    I say he appeals to the Supreme Court before June 2015, gets denied and is executed sometime in 2015.

    I'll give you a short lesson. Moh posted the link to Cole's case before SCOTUS. He's already appealed to SCOTUS and it's scheduled for this week's conference. We will see the decision next Monday. If denied he could get a date in December or January.
