Richard Stephen Fairchild - Oklahoma Execution - November 17, 2022

    Facts of the Crime:

He was convicted for the 1993 beating death of his girlfriend's three-year-old son, Adam Broomhall, in Oklahoma County. He was convicted in 1996. The boy had severe burns on his back from being held against a heater. Stacy Broomhall pleaded guilty to permitting the abuse of her son and received a five-year deferred sentence. She testified against Fairchild at trial, saying they had been drinking heavily and that she was passed out when the killing happened.

Fairchild has been on death row since February 14, 1996.

Appeals court upholds death penalty in Oklahoma case

    By Robert Boczkiewicz
    The Oklahoman

DENVER — An appeals court has let stand a death sentence for a Del City man convicted of murdering his girlfriend’s 3-year-old son by brutally beating and burning him.

The 10th U.S. Circuit Court of Appeals denied the claim of Richard Fairchild that he did not receive a fair trial in Oklahoma County District Court for the 1993 child-abuse murder of Adam Scott Broomhall.

Judges of the Denver-based appeals court ruled 3-0 Thursday in a lengthy decision against Fairchild.

    Abuse described

Court records state Fairchild admitted hitting the child several times with strong blows and holding his body against a hot wall heater because the boy wouldn’t stop crying after waking up.

“The more he screamed the more I just kept on hitting him,” Fairchild, who was 33, was quoted as telling a detective at the time of the crime.

Fairchild and the boy’s mother had been drinking heavily that night, police said.

His attorney argued that Fairchild’s constitutional rights were violated because instructions to jurors purportedly did not adequately explain a possible sentence of life without the possibility of parole.

The attorney, Assistant Federal Public Defender Randy Bauman, of Oklahoma City, also raised the issue that Fairchild’s rights were violated because the instructions did not include a possible verdict of a lesser crime than first-degree murder.

Bauman also argued that Fairchild’s previous attorneys in earlier stages of the case were ineffective in representing him.

The only way I would have given this mother a deferred sentence, is if she agreed to be sterilized.

U.S. Supreme Court rejects final appeals of two on Oklahoma's death row

WASHINGTON — The U.S. Supreme Court on Monday rejected the final appeals of two Oklahoma death row inmates, but Attorney General Scott Pruitt declined to seek execution dates while the state's lethal injection process is under review.

Without comment, the high court declined to review the cases of:

    •Richard Fairchild, convicted in Oklahoma County of first-degree child abuse murder for the 1993 killing of his girlfriend's three-year-old son; Adam Broomhall;

•Jeremy Alan Williams, convicted of first-degree murder in Tulsa County for his part in the 2004 shooting death of bank teller Amber Rogers during the robbery of the First Fidelity Bank.

Fairchild is 56; Williams is 32.

The attorney general typically asks the Court of Criminal Appeals to set execution dates for death row inmates who have exhausted their appeals.

But Pruitt told the court Monday it would be inappropriate to seek execution dates while the investigation of the Corrections Department's protocol for lethal injection is ongoing.

There are now five death row inmates who have exhausted their appeals. The executions of three inmates were previously delayed.

The investigation was prompted by the discovery that a pharmacy had delivered the wrong drugs for the Sept. 30 execution of Richard Glossip.

Before that blunder, the constitutionality of the state's lethal injection protocol had gone all the way to the U.S. Supreme Court and been narrowly upheld last summer. The challenge stemmed from the trouble-plagued execution in 2013 of Clayton Lockett.

Glossip was to be the first inmate executed after the Supreme Court decision.

In calling for the investigation, Pruitt said in October that "the state owes it to the people of Oklahoma to ensure that, on their behalf, it can properly and lawfully administer the sentence of death imposed by juries for the most heinous crimes ... Until my office knows more about these circumstances and gains confidence that (Corrections Department) can carry out executions in accordance with the execution protocol, I am asking the Oklahoma Court of Criminal Appeals to issue an indefinite stay of all scheduled executions."

2 more death row inmates await execution dates amid probe

Two more Oklahoma death row inmates have exhausted their appeals and are ready to have execution dates set once the state finishes its investigation into drug mixups during the last two lethal injections.

The Oklahoma Court of Criminal Appeals released an order Monday for stays of execution for two convicted killers — Richard Stephen Fairchild and Jeremy Alan Williams.

Oklahoma Attorney General Scott Pruitt notified the court both men had exhausted their appeals, but that execution dates shouldn't be set while a grand jury investigates how the wrong drug was delivered for the last two lethal injections.

One inmate was executed using the wrong drug in January 2015, and a second inmate was just hours away from his lethal injection in September when prison officials noticed the mistake.
