Appeals Court rejects appeal from Okla. death row

A federal appeals court on Thursday refused to overturn an Oklahoma City motel manager's murder conviction and death sentence, saying that even if errors occurred at his trial, they didn't add up to anything that should void the results.

Richard Eugene Glossip was convicted twice in the Jan. 7, 1997, death of Barry Alan Van Treese, 54. Prosecutors said Glossip feared Van Treese would fire him for failing to properly maintain the Best Budget Inn in south Oklahoma City.

Jurors convicted Glossip in 1998, but the Oklahoma Court of Criminal Appeals voided the trial, ruling that defense lawyers did a poor job. Another jury convicted Glossip in 2004 and the death row inmate went to the 10th U.S. Circuit Court of Appeals to argue he didn't receive a fair trial.

According to the court, Glossip promised a maintenance man $10,000 to beat Van Treese to death with a baseball bat in one of the motel's rooms. The maintenance man pleaded guilty in the death and testified against Glossip.

Glossip told the Denver-based Appeals Court that prosecutors were wrong to hang posters in the courtroom outlining the government's evidence, that his defense team was inadequate and that he couldn't challenge victim-impact statements.

A three-judge panel said many of the posters displayed statements that Glossip had given investigators and that the trial was not "infected." The panel also said that while his lawyers didn't use a taped interview from the maintenance man, his legal team did confront him about inconsistencies in his testimony over the years.

The judges also said that allowing victim-impact statements to be read by others didn't harm Glossip's case.

The Appeals Court said it reviewed the 17-volume trial transcript and found that Glossip received a "fundamentally fair trial."

"Even aggregating the individual harmless errors recognized or assumed above, the error did not have a substantial and injurious effect or influence on either the jury's determination of Glossip's guilt or its decision to impose the ultimate sanction of the death penalty," the judges wrote.

The Oklahoma Court of Criminal Appeals had overturned Glossip's 2001 conviction on grounds he received an inadequate defense. That ruling also included an admonition to judges to prevent jurors from consulting the Bible in the jury room after finding there was "credible evidence" that jurors carried one in.

Another Oklahoma death row inmate loses final appeal

The U.S. Supreme Court on Monday rejected the final appeal of an Oklahoma death row inmate who was convicted of killing an Oklahoma City motel owner in 1997.

Without comment, the court declined to review the case of Richard Glossip, who received the death penalty for killing Barry Alan Van Treese at the Best Budget Inn.

The 10th U.S. Circuit Court of Appeals ruled last year that Glossip had received “a fundamentally fair trial.”

Typically after a death row inmate exhausts his appeals, the state attorney general requests an execution date.

However, Oklahoma’s execution protocols are currently being reviewed because of problems last week in the execution of Clayton Lockett.

    Another case

In a separate filing, the attorney general’s office also asked that an execution date be set for another Oklahoma inmate, Richard Glossip. In that filing, Branham wrote that even though the state needs to consider Thompson’s investigation, it is important to set a date for Glossip’s execution to strengthen the public’s confidence Glossip will be put to death for his crimes.

Glossip, 51, was sentenced to die for his role in the 1997 killing of Barry Alan Van Treese at Oklahoma City’s Best Budget Inn.

Glossip, who is now 51, was a manager at the motel. Prosecutors said Glossip feared being fired and devised a plot to kill Treese. The motel’s maintenance man, Justin Sneed, pleaded guilty to killing Treese, and he testified against Glossip in exchange for a sentence of life without parole.

Oklahoma Lines Up 2nd Execution After Review Of Clayton Lockett's Death

OKLAHOMA CITY - An Oklahoma inmate is scheduled for a November execution after telling a court he didn't want to be the first in line after a review of a botched try that ended with a prisoner's heart attack.

The Oklahoma Court of Criminal Appeals on Wednesday set Richard Eugene Glossip's execution for Nov. 20. He's second in line.

Clemency hearings scheduled for Oklahoma, Osage county killers

OKLAHOMA CITY — The Oklahoma Pardon and Parole Board on Monday set an execution date for Osage County killer John Marion Grant.

Grant is set to die Dec. 4 for the 1998 murder of Gay Carter, a food service supervisor at the Dick Connor Correctional Center in Hominy, where he was serving time.

According to court records, Grant was fired from his job in the prison kitchen for fighting with another inmate. After that, he threatened Carter.

He pulled her into a mop closet, covered her mouth and stabbed her several times in the chest, according to court records. She had 16 stab wounds, one of which punctured her aorta, according to court records.

Grant had prior convictions for burglary and robbery.

His clemency hearing is set for 1 p.m. Nov. 21.

The Pardon and Parole Board also set a 1 p.m. Oct. 24 clemency hearing for Oklahoma County killer Richard E. Glossip.

Glossip is set to die Nov. 20 for his role in the 1997 death of Barry Van Treese, who owned the Best Budget Inn in Oklahoma City where Glossip worked.

Justin Sneed, who did maintenance work at the motel, admitted to killing Van Treese at Glossip’s instructions, according to court records.

Van Treese had suspected financial irregularities at the motel, according to court records.

Oklahoma County killer Charles F. Warner is set to die Nov. 13 for the 1997 killing his roommate’s daughter, Adrianna Waller, who was 11 months old.

He was also convicted of her rape.

The Pardon and Parole Board earlier this year denied clemency for Warner.
