    Facts of the Crime:

    On April 27, 2001, Hancock shot and killed Robert Jett and James Lynch. The prosecution argued that he had shot one of the victims while the man was fleeing, and taunted the other victim between gunshots. Hancock argued that he had acted in self-defense.

    Hancock has been on death row since November 2, 2004.

    US appeals court upholds death penalty in double homicide

    OKLAHOMA CITY (AP) - A federal appeals court has upheld the death penalty of an Oklahoma man convicted in the shooting deaths of two men.

    In a divided opinion Tuesday, a three-judge panel of the 10th U.S. Circuit Court of Appeals upheld the death sentence of 51-year-old Phillip Hancock of Guthrie.

    The Oklahoma Court of Criminal Appeals previously upheld Hancock's first-degree murder convictions and death sentence.

    An Oklahoma County jury convicted Hancock of the April 27, 2001, shooting deaths of 37-year-old Robert L. Jett Jr. and 58-year-old James V. Lynch. Defense attorneys had argued Hancock was in a fight with the victims and shot them in self-defense.

    Among other things, the federal appeals court rejected assertions that the trial court misled Hancock's jury with what Hancock's attorneys claimed were unwarranted legal instructions on self-defense.

    Three more Oklahoma death row inmates lose final appeals

    WASHINGTON - The U.S. Supreme Court on Monday declined to review the appeals of three Oklahoma death row inmates. There are now 11 inmates eligible for execution dates when the state resumes lethal injections.

    Without comment, the justices rejected appeals from:

    -- Phillip Hancock, convicted of two counts of first-degree murder and given the death penalty for the 2001 shooting deaths of Robert L. Jett Jr., 37, and James V. Lynch, 58, both of Oklahoma City;

    -- Julius Darius Jones, who was a University of Oklahoma freshman when he shot and killed Edmond insurance company executive Paul Howell, 45, in the driveway of his parents' home in Edmond; and

    -- Anthony Castillo Sanchez, convicted of raping and murdering OU dance student Jewell Buskin in 1996.

    Oklahoma Attorney General Scott Pruitt has delayed seeking execution dates while the Oklahoma Department of Corrections reviews its lethal injection process. Pruitt has said he would wait at least 150 days after the department releases a report before seeking execution dates.
