    A Del City man who prosecutors said has been in trouble for half his life was sentenced to death Thursday for killing a convenience store owner during a 2004 robbery.

    Marlon Deon Harmon, 27, did not react when Oklahoma County District Judge Jerry Bass read the jury's verdict, which came after less than two hours of deliberation.

    Harmon was convicted Tuesday of first-degree murder in the death of Kamal Choudhury.

    Choudhury, 55, was the owner of Q&S Food Store, 3244 NW 26. He was shot three times in the Aug. 23, 2004 robbery of his store and died the next day.

    Choudhury's widow sobbed after Harmon was sentenced to death.

    Harmon's attorneys asked the seven-man, five-woman jury to spare his life, detailing his troubled upbringing.

    Defense attorney Cathy Hammarsten said jurors needed to know Harmon before deciding his fate, but prosecutors maintained nothing they learned was enough to warrant sparing him from the death penalty.

    Assistant District Attorney Scott Rowland said Harmon, who turns 28 in two months, has been creating victims since he was 14, when he pointed a gun at another teenager.

    Harmon went to prison before he reached adulthood and was responsible for a number of other robberies after his release, Rowland said.

    He said the death penalty was the just outcome in Harmon's case.

    Formal sentencing was set for July 2.

    Okla. court hears death penalty case

    OKLAHOMA CITY (AP) - Attorneys for a man convicted in the 2004 shooting death of an Oklahoma City convenience store owner are asking a state appeals court to overturn his death sentence.

    Oklahoma County public defender Andrea Miller argued Tuesday before the Oklahoma Court of Criminal Appeals that a videotaped exchange between 30-year-old Marlon Harmon and a co-defendant should not have been shown to the jury.

    Harmon was convicted of first-degree murder in 2008 in the death of 55-year-old Kamal Choudhury. Choudhury was shot three times in the Aug. 23, 2004, robbery of the Q&S convenience store.

    Harmon's interview with police was not admitted at trial, but prosecutors did play an exchange between him and a co-defendant.

    An attorney for the state argued other evidence in the case was sufficient for a conviction.

    The Oklahoma Court of Criminal Appeals has upheld the first-degree murder conviction and death sentence of an Arkansas man convicted in the shooting death of a convenience store clerk in Oklahoma City.

    An Oklahoma County jury found 30-year-old Marlon Deon Harmon guilty in 2008 of the Aug. 17, 2004, fatal shooting of 55-year-old Kamal Choudhury, owner of the Q&S convenience store.

    The five-member appellate court upheld Harmon's conviction and death sentence in a unanimous 54-page decision handed down Thursday.

    Harmon's defense attorney had asked the court for a new trial because jurors were shown an inadmissible videotape. But prosecutors said other evidence, including eyewitnesses who placed him at the scene and a print of Harmon's palm found on a card from the victim's wallet, was sufficient for a conviction.

    In Monday's (October 3, 2011) United States Supreme Court orders, Harmon's petition for a writ of certiorari and motion for leave to proceed in forma pauperis was DENIED.

    An Oklahoma appeals court has rejected a request for an evidentiary hearing by an Arkansas man convicted in the shooting death of a convenience store clerk in Oklahoma City.

    The Oklahoma Court of Criminal Appeals handed down the decision Friday in the case of 32-year-old Marlon Deon Harmon. Harmon was convicted of first-degree murder and sentenced to death for the 2004 fatal shooting of 55-year-old Kamal Choudhury. Choudhury was the owner of the Q&S convenience store.

    The court upheld Harmon's conviction and death sentence last year. Prosecutors said evidence, including eyewitnesses who placed him at the scene and a print of Harmon's palm found on a card from the victim's wallet, was sufficient for a conviction.

    His attorney, Kristi Christopher, did not return a phone call seeking comment.
