    Convicted Tulsa Murderer Sentenced To Death

    TULSA, OK -- A Tulsa County associate district court judge followed a jury's recommendation Tuesday morning and sentenced Raymond Johnson to death for two counts of first-degree murder for the killing of a mother and her child.

    Last month, a jury convicted Johnson of beating Brooke Whitaker to death with a hammer and then setting the house on fire, which also killed her 7-month-old daughter.

    The jury also recommended Johnson be sentenced to life in prison on the first-degree arson conviction.

    Death penalty appeal set for Tulsa double slaying

    An appellate hearing is scheduled for a Tulsa man sentenced to die for the 2007 killings of his ex-girlfriend and her 7-month-old daughter.

    Oral arguments are scheduled Tuesday before the Oklahoma Court of Criminal Appeals in the case of 37-year-old Raymond Eugene Johnson.

    Johnson was sentenced to die after a Tulsa County jury found him guilty of two counts of first-degree murder for the June 2007 slayings of 24-year-old Brooke Whitaker and 7-month-old Kya Whitaker.

    Prosecutors alleged that Johnson beat Brooke Whitaker with a hammer, set her on fire, and left her and the baby to burn in their home, which he had doused with gasoline.

    A telephone message left Monday with Johnson's attorney was not immediately returned.

    Court asked to toss confession in double murder, arson

    OKLAHOMA CITY - Tulsa County killer Raymond Eugene Johnson "hung himself" in a 45-minute confession, the Court of Criminal Appeals was told Tuesday.

    The court was asked by Tulsa County Assistant Public Defender Curt Allen to toss out the confession and give Johnson a new trial or new sentencing. Allen said the statement was coerced, adding that Johnson was physically abused by police.

    Johnson received two death sentences for the 2007 murder of his former girlfriend Brooke Whitaker and their 7-month-old daughter, Kya.

    He also received a life-in-prison sentence for arson.

    Whitaker was struck 24 times in the head with a hammer before her Tulsa home was doused with gasoline and set on fire. Whitaker died of blunt force trauma to the head and smoke inhalation. The child's cause of death was listed as thermal injury.

    The Court of Criminal Appeals on Tuesday heard oral arguments in Johnson's challenge to his conviction and sentence.

    "There are some terrible facts in this case," Allen said. But if the law wasn't followed, there is a problem with the case, he said.

    Allen argued that the jury might have passed on the death penalty if it had not heard the confession.

    He said pictures of Johnson indicate he suffered injuries to his face, adding that the confession was coerced.

    Appeals Judge Gary Lumpkin said the statement was essentially a confirmation of other facts presented in the case.

    Allen said he was contesting the effect it had during the sentencing phase.

    Assistant Attorney General Jennifer Strickland said the jury found four aggravating factors in meting out the death sentence, including a prior conviction for manslaughter.

    During the confession, Johnson looks sleepy, bored and does not look intimidated, as Allen suggested, Strickland said, adding there is no evidence to support claims of abuse by police.

    The judges did not indicate when they would render a ruling.

    The Supreme Court won't overturn a death sentence for a man convicted of killing his ex-girlfriend and her infant daughter in Oklahoma.

    The high court on Monday refused to hear an appeal from Raymond Eugene Johnson. Johnson was convicted of two counts of first-degree murder by a Tulsa County jury in 2009 in the June 2007 deaths of Brooke Whitaker, 24, and her 7-month-old daughter, Kya Whitaker. Prosecutors said Johnson beat Brooke Whitaker in the head with a hammer, set her on fire and left her and the baby to burn in their gasoline-doused home.

    Oklahoma courts have refused to stop his execution, and the high court now also has refused to intervene.

    Okla. Court Rejects Death Row Inmate's Appeal

    An Oklahoma appeals court has rejected a death row inmate's request to raise new issues to challenge his death sentence.

    The state Court of Criminal Appeals handed down the decision Wednesday in the case of 40-year-old Raymond Eugene Johnson.

    Johnson was convicted of two counts of first-degree murder and sentenced to death by a Tulsa County jury in the June 2007 deaths of 24-year-old Brooke Whitaker and her 7-month-old daughter, Kya Whitaker.

    The appeals court upheld Johnson's conviction and death sentence in 2012. The U.S. Supreme Court refused to hear Johnson's appeal the same year.

    In the latest filing, the appeals court rejected Johnson's request for a hearing on allegations that his previous attorneys have been ineffective.

    His attorney, Beverly Atteberry, did not immediately return a telephone call seeking comment.
