    Death sentence stands in 1999 murder of Edmond businessman

    DENVER — An appeals court Friday let stand the death sentence of a former University of Oklahoma freshman, who was on a leadership scholarship, for the 1999 murder of an Edmond insurance executive.

    The 10th U.S. Circuit Court of Appeals denied the claim of Julius Darius Jones that his trial attorney was ineffective for failing to seek evidence that someone else had committed the crime.

    Paul Howell, 45, was fatally shot in the head in the driveway of his parents’ home in Edmond just before his vehicle was stolen. Jones was 21 when he was convicted in 2002 in Oklahoma County District Court.

    The Denver-based appeals court, in a 26-page decision, stated that “the evidence of Jones’ involvement in Howell's murder...was quite strong, if not overwhelming.”

    The court stated that it agreed with an earlier decision of the Oklahoma Court of Appeals that “it was not reasonably likely that the result of the trial would have been different” if Jones’ attorney had pursued additional evidence.

    On May 6, 2015, oral argument will be heard in Jones' appeal before the US Court of Appeals for the Tenth Circuit. Perhaps this is before the court sitting en banc.

    In today's opinions, the Tenth Circuit DENIED Jones' appeal. The panel was made up of Judges Matheson (Obama), Bacharach (Obama) and Moritz (Obama).
