    Summary of Offense:

    He was convicted in the 1992 shooting death of convenience store owner Kenneth Meers in Oklahoma City. Littlejohn and Glenn Roy Bethany went to the Root 'n' Scoot with the motive of robbery. Prosecutors say Littlejohn was the triggerman. Bethany was convicted of first-degree murder and robbery and sentenced to life in prison without parole.

    Littlejohn has been on death row since March 10, 2000.

    OKLAHOMA CITY (AP) -- A divided federal appeals court has ordered a hearing on a convicted Oklahoma killer's claim of ineffective counsel during the penalty phase of his trial when he was sentenced to death. Emmanuel Littlejohn was convicted and sentenced to death for the 1992 shooting death of a man during an Oklahoma City convenience store robbery. A three-judge panel of the 10th U.S. Circuit Court of Appeals in Denver voted 2-1 in a ruling released Monday that Littlejohn's claim of ineffective counsel was wrongly rejected by a federal court in Oklahoma. The appeals court said Littlejohn's attorney should have further investigated claims by a psychiatrist that Littlejohn suffered brain damage from his birth and childhood. The court said a neurological evaluation could have uncovered evidence of the alleged brain damage.

    In today's opinions, the Tenth Circuit AFFIRMED the District Court's denial of Littlejohn's habeas petition. The panel was made up of Judges Tymkovich (G.W. Bush), Lucero (Clinton), and Holmes (G.W. Bush).
