    Supreme Court rejects another final appeal for state death-row inmate; 13 now eligible for execution date

    WASHINGTON — James Chandler Ryder, convicted of killing a woman and her son over some personal belongings in 1999, is now the 13th Oklahoma death row inmate who has exhausted appeals and is eligible for an execution date.

    The U.S. Supreme Court on Monday declined, without comment, to review Ryder’s appeal. It was the fifth time since the high court’s new term began in October that justices have rejected the final appeal in an Oklahoma capital case.

    In such instances, the Oklahoma attorney general typically moves quickly to request an execution date from the Oklahoma Court of Criminal Appeals.

    But problems with lethal injections in Oklahoma have led to a pause in executions while the state Department of Corrections reviews the process.

    Is he likely to get relief? I don’t think the victims were Native American nor was he. How exactly can this ruling apply to them even if it was on so called tribal land? They are not even Native American.

    That the Hallums are enrolled members of the Chocktaw Nation is not a matter of dispute.

    If they are then yeah he’s off DR. The other thing I want to confirm is that the McGirt thing won’t apply if your not Native American correct even if it happened on what counts as tribal land. One or both of the parties have to be considered members correct?

    The issue here is that technically the whole state is former native land and if the inmates start to pull those cards which they will it might get everyone off due to the jurisdiction problems. OK is screwed by this "Conservative Court".

    What I thought about and what you thought about last year Mike is coming into fruition. This ruling was going to have a serious impact on Oklahoma’s Death Row and it’s come into strong fruition. The case relief numbers went from two with Murphy and Bosse last year to 10 this year. Oklahoma will probably never execute again after this ruling.

    Only the land initially granted to the Five Civilized Tribes is subject to this ruling, mostly the eastern part of the state. OKC itself is not affected but the lands do involve part of the city of Tulsa.

    Not just SCOTUS, they were upholding the Tenth in that ruling.

    The attorney is using McGirt to make the General Crimes Act applicable to subject the case to a federal, not state, jurisdiction.

    But this won’t apply to them if neither of them are Native American correct? It’s hard to square what native land would be? How do you square something that’s so old? What’s native land in eastern Oklahoma? Everything?

    Correct - the law specifically exempts crimes not involving native Americans on tribal land absent a treaty to the contrary.
