    Facts of the Crime:

    Convicted and sentenced to death for the 1996 slaying of University of Oklahoma dance student Jewell "Juli" Busken. In 2004, state investigators found a match between the profile and a profile taken from Sanchez when he entered the prison system on a burglary conviction. State law mandates all violent offenders and convicted burglars submit a blood sample so their DNA profiles can be entered into a statewide database.

    Sanchez has been on death row since June 6, 2006.

    Man convicted in Arkansas ballerina's death loses appeal

    OKLAHOMA CITY (AP) — A man who was sentenced to death for the 1996 rape and killing of a University of Oklahoma dance student lost a bid on Monday for a new trial.

    Attorneys for Anthony Castillo Sanchez appealed his 2006 conviction in the slaying of Jewell "Juli" Busken on several grounds, the main one being that the trial court erred in allowing him to be tried before a jury while wearing shackles.

    The Oklahoma Court of Criminal Appeals rejected that and other arguments in a 23-page opinion.

    Sanchez's attorneys at the Oklahoma Indigent Defense System didn't immediately return a phone call seeking comment.

    Busken, of Benton, was found along the shore of Lake Stanley Draper in southeast Oklahoma City on Dec. 20, 1996. Investigators said she was raped, shot and bound after being abducted from the parking lot of the Norman apartment complex where she lived.

    Sanchez was identified as a suspect in 2004 when state investigators said they matched a DNA sample taken from him with DNA evidence collected from the crime scene. A Cleveland County jury convicted Sanchez in 2006 of first-degree murder and rape, and sentenced him to death.

    The Oklahoma Attorney General's Office said this is the first appeal in the process for Sanchez, who can next request post-conviction relief from the Court of Criminal Appeals before moving into the federal phase.

    "We are pleased with the court's denial of his direct appeal and we will continue to oppose his appeals as they move through the system," said Charlie Price, a spokesman for the Attorney General's Office.

    Monday's decision comes months after jurors in the case testified at an evidentiary hearing that they never saw Sanchez wearing leg shackles. Sanchez's attorneys were concerned that seeing him in restraints could have affected the jurors' verdict.

    Retired sheriff's deputy Paul Bugher testified that Sanchez always was seated before the jury entered the courtroom, and any restraints wouldn't have been visible.

    In its opinion, the appeals court wrote that the district court erred in shackling Sanchez without recording whether a required factual determination that Sanchez posed a security risk had been made. Even so, the court decided that overturning the lower court decision wasn't warranted.

    Sanchez's attorneys also appealed on the grounds that the court denied a full examination of prospective jurors' opinions about the death penalty, and that the collection of DNA from Sanchez violated his constitutional rights against unreasonable search and seizure.

    Mary Busken, the victim's mother, said she was glad the court had rejected Sanchez's appeal.

    "I was beginning to worry," she said by telephone. "We had that little hearing in May and all the jurors had to be called back to testify. It was kind of like going through a mini-trial again."

    Ballerina's Murder Still Haunts Norman 15 Years Later

    NORMAN, Oklahoma -- It's the height of the holiday season in Cleveland County, but like the ghost of Christmas past, what took place on the streets of Norman 15 years ago continues to haunt Cleveland County.

    In the early morning hours of December 20, 1996, OU ballerina Juli Busken disappeared from her east Norman apartment.

    For those closest to the case, what happened to Busken is still fresh in their minds.

    "The most dreaded call you can receive is a call that one of your students has been killed in a tragedy," OU President David Boren said. "I'll still remember forever, the call from Joe Lester, now the county sheriff who was chief of police at the time, telling me that Juli Busken had been killed."

    "To this day, I still see the face of Bud and Mary Jean Busken sitting there in the audience, listening to every single gory detail about this trial," Former Cleveland County District Attorney Tim Kuykendall said.

    Kuykendall said the night before Busken's murder, was just like any other December night.

    "The night before, she'd been out with some friends," Kuykendall said. "They had a going away party, a Christmas party, saying their goodbyes. They thought their goodbyes were for the semester, until after Christmas. Little did they know that their goodbyes would be forever."

    They would find her body on the shores of Lake Stanely Draper raped and murdered just hours after she disappeared, but there would be more questions than answers as to just what happened.

    "If you can imagine being out in 10 below zero or 20 below zero weather, and being kidnapped, raped and murdered and being left at the edge of Lake Stanley Draper, that was a horrific crime," Cleveland County Sheriff Joe Lester said.

    Busken's killer, Anthony Sanchez, was convicted of her murder back in 2006, and his appeal for a retrial has been denied. He is currently sitting on death row.

    But just because Busken is gone, that doesn't mean she is forgotten.

    "Here's a loved one that has such a brilliant future ahead of her," Lester said. "Here's a loved one that was a sister, an aunt, that was a friend, a cousin, a daughter, a granddaughter that will never, ever, ever get to share the future with her family."

    OU President David Boren watched Busken perform in the musical Swan Lake the semester before she was killed. Boren says he remembers Busken fondly.

    "She had a beautiful spirit about her," Boren said. "Even when you just saw her walking across campus in her everyday street clothes, you felt she walked with such dignity and grace that you'd say to yourself 'I bet she's a ballet dancer'."

    Busken's memory still lives on in the form of a dance scholarship at the OU College of Fine Arts.

    Those close to the Busken family are asking the OU Board of Regents to endow the scholarship so Busken's memory will live forever at OU.

    In today's orders, the United States Supreme Court declined to review Sanchez's petition for certiorari.

    Appeals exhausted. Ruling could result in execution date.
    Don't ask questions, just consume product and then get excited for next products.

    Three more Oklahoma death row inmates lose final appeals

    WASHINGTON - The U.S. Supreme Court on Monday declined to review the appeals of three Oklahoma death row inmates. There are now 11 inmates eligible for execution dates when the state resumes lethal injections.

    Without comment, the justices rejected appeals from:

    -- Phillip Hancock, convicted of two counts of first-degree murder and given the death penalty for the 2001 shooting deaths of Robert L. Jett Jr., 37, and James V. Lynch, 58, both of Oklahoma City;

    -- Julius Darius Jones, who was a University of Oklahoma freshman when he shot and killed Edmond insurance company executive Paul Howell, 45, in the driveway of his parents' home in Edmond; and

    -- Anthony Castillo Sanchez, convicted of raping and murdering OU dance student Jewell Buskin in 1996.

    Oklahoma Attorney General Scott Pruitt has delayed seeking execution dates while the Oklahoma Department of Corrections reviews its lethal injection process. Pruitt has said he would wait at least 150 days after the department releases a report before seeking execution dates.

    Oklahoma appeals court denies hearing for man convicted in OU ballerina’s death

    The Oklahoma Court of Criminal Appeals has denied a request for a new hearing for a 39-year-old man who was sentenced to death in the 1996 killing of a University of Oklahoma ballerina.

    The appeals court handed down the decision Tuesday in the case of Anthony Sanchez, who was convicted of first-degree murder in the death of 21-year-old Juli Busken of Benton, Arkansas.

    Busken had completed her last semester at OU when she was abducted on Dec. 20, 1996. Her body was found that evening in southeast Oklahoma City. She had been raped and shot in the head.

    Among other things, Sanchez claims his race and the victim’s gender were factors in the death penalty he received. His attorney, Mark Barrett, says he’s disappointed by the court’s decision.
