    Facts of the Crime:

    A Lexington County jury in 2006 deliberated less than three hours before recommending the death penalty for Kevin Mercer for shooting Sgt. 1st Class Tracy Davis, 35, a U.S. Army recruiter, to death outside Davis’ Fernandina Road apartment on May 16, 2002. Mercer and an accomplice killed Sgt. 1st Class Tracy Davis, 35, a U.S. Army recruiter at Fort Jackson, because they wanted Davis’ 1999 Lincoln Navigator to drive to a party in Atlanta. Mercer had a long criminal record, and had attacked another inmate with a shank in 2004. Mercer claimed the other passenger found with him in the vehicle was the killer.

    The state Supreme Court has upheld the death sentence of a man convicted of killing a Fort Jackson sergeant in 2002.

    A Lexington County jury in 2006 deliberated less than three hours before recommending the death penalty for Kevin Mercer for shooting Sgt. 1st Class Tracy Davis, 35, a U.S. Army recruiter, to death outside Davis’ Fernandina Road apartment May 16, 2002.

    Lexington County Sheriff’s deputies said Mercer and an accomplice killed Davis because they wanted Davis’ 1999 Lincoln Navigator to drive to a party in Atlanta.

    The Supreme Court, which automatically reviews all death sentences in initial appeals, unanimously upheld Mercer’s sentence.

    On October 5, 2009, the US Supreme Court denied Mercer's certiorari petition on direct appeal.

    According to the NAACP legal defense fund and the South Carolina Department of Corrections, he is no longer listed on death row.
