    South Carolina May Not Have Drugs for December Execution

    COLUMBIA, S.C. (AP) — South Carolina has scheduled its first execution in more than six years. But it's unknown if the state has the drugs needed to carry out lethal injection.

    The Department of Corrections last week received its first execution order in more than six years. Supreme Court justices set a December 1 execution date for Bobby Wayne Stone, a 52-year-old man on death row for killing a Sumter County sheriff's deputy.

    South Carolina primarily uses lethal injection and hasn't carried out an execution since 2011.

    But the state's supply of one of the three drugs it uses expired in 2013, and officials haven't been able to get more, with companies unwilling to sell drugs used for executions.

    State officials didn't immediately comment on their plans for carrying out Stone's execution.

    If the state was actually serious about the execution they wouldn't of scheduled it on a Friday.

    Motts was executed on a Friday. Even though he was a volunteer.

    Bobby Wayne Stone — LEGALLY PREMATURE DEATH WARRANT

    Warrant pending. The death warrant was issued before Stone had been provided habeas corpus review to which he is entitled as a matter of federal law. The U.S. Supreme Court's 1994 decision in McFarland v. Scott says that capital habeas petitioners in Stone’s position are entitled to a stay of execution to protect their right to habeas corpus review.

    The thing with volunteers is that they won't file appeals and the courts are highly unlikely to give any time to anyone else's on their case. Giving a Friday date to a guy that will appeal isn't a good idea since the courts close on the weekends.

    This administrative execution date was unacceptable by the South Carolina Supreme Court. The death warrant is misleading considering that the status of Stone's appeals has not gone to Federal appeals stage yet. There will be an execution date after he has exhausted his state and federal appeals. 2019/2020 could be the earliest in Stone having an execution date!

    Where are you basing your years from Ryan? Only one person in 7 years from SC has had their habeas denied. It is likely that Stone's case will be sitting in the courts for decades, he is far from finishing his appeals due to SC's extremely slow courts.

    I'm questioning if this even was a administrative date. Other people have had their state level appeals denied in the past 6 years and are the same stage as Stone yet none of them got a date that we know about.
