Eugene Stradford Pleads Guilty and Gets 33 Years in 2010 NC Slaying of Robert Scott

Death penalty sought in 2 murder cases

Mecklenburg prosecutors said Thursday they intend to seek the death penalty against two Charlotte men accused of murder in two separate cases in April.

In one case, Eugene Stradford, 40, is charged with first-degree murder and assault with a deadly weapon in the April 13 stabbing of Robert Lee Scott.

Police said witnesses told them Scott had given Stradford a ride in his van. But after parking the vehicle in northwest Charlotte, police said, Stradford said he was going to take the van. When Scott resisted, police said he was stabbed in the chest by Stradford, who then fled in the van.

Scott died from his injuries two weeks later.

Prosecutors must cite at least one aggravating factor in order to seek the death penalty.

In Stradford's case, he had previously been convicted of second-degree murder in 1991. Records show he was sentenced to up to 35 years in prison, but was released early in 2004.

In the second case, Michael Walker, 32, is charged with murder and child abuse inflicting serious bodily injury in the April 12 death of Zione Washington, the 18-month old son of his girlfriend. The mother told authorities she'd left the toddler and his two siblings at home with Walker while she went out to get cigarettes, and was gone about 15 minutes.

Assistant District Attorney Gabrielle Macon said Walker confessed to hitting Zione with his fists and a plastic bowling pin. The toddler sustained bruises to his back, chest, arm, forehead and jaw, she said, and died at the hospital.

Walker's attorney, Susan Weigand, said she didn't believe there was enough evidence to support elevating the case to a capital crime. She said the state has not sought the death penalty in some cases where a medical examiner found the injuries to a child to be "much worse."

But Macon contended there were special circumstances in the case, calling the death "especially heinous, atrocious and cruel." She told Mecklenburg Superior Court Judge Forrest Bridges that Walker had "essentially left this child helpless." Walker, she said, told authorities the toddler had been whimpering after being hit, and had opportunity to call for help or tell the hospital the extent of the child's injuries. But she said he didn't confess until after authorities showed him the child's injuries.

Records showed Walker has no criminal history in North Carolina.
