    Facts of the Crime:

    Two men who participated in the killing of 16-year-old West Philadelphia resident Alexander Porter after leading him to believe they were going to set him up in the drug business were sentenced on November 14, 1989 to death in the electric chair. Common Pleas Judge Albert F. Sabo imposed the sentence on Kevin Pelzer and Henry "Butch" Daniels after the jury that convicted the pair set the penalty at death.

    Pelzer was sentenced to death in Philadelphia County on November 14, 1989.

    Supreme Court of Pennsylvania

    The Commonwealth appeals from the order of the Philadelphia County Court of Common Pleas granting appellees Henry Daniels and Kevin Pelzer relief on their petitions under the Post Conviction Relief Act (“PCRA”), 42 Pa.C.S. §§ 9541-9546.   By order dated March 25, 2003, the PCRA court granted both appellees relief on two claims, ordered a new trial, and denied the remaining claims.   Appellees, acting as Cross-Appellants, have filed cross-appeals renewing the issues that the PCRA court dismissed.   For the reasons set forth below, we vacate the order of the PCRA court and remand for further proceedings consistent with this opinion.

    Pelzer's sentence was reversed on August 26, 2011.

    On April 13, 2015, Pelzer filed a habeas petition in Federal District Court.
