    Allentown double-murder trial continued

The trial of a Milton man accused of murdering an engaged couple and leaving their bodies on the side of an Allentown road was continued today until next month.

Robert Hobart, 43, will now face trial the week of Oct. 15, authorities said. The State Attorney’s office is seeking the death penalty against Hobart, who allegedly shot Robert Hamm, 41, and Tracie Tolbert, 43, in their heads in September 2010.

Hobart then left the couple’s bodies on opposite sides of Jesse Allen Road. Several weeks after the shooting, DNA obtained from Hobart’s brother’s gun linked Hobart to the killings, according to an arrest report.

Jury selection was to start Monday in front of Circuit Judge David Rimmer.

Closing arguments this morning in Santa Rosa murder trial

Closing arguments are set to begin this morning in the trial of a Milton man accused of murdering an engaged couple in September 2010.

Robert Hobart, 43, is charged with two counts of first-degree murder in the deaths of Robert Hamm, 41, and Tracie Tolbert, 43. The pair were found on opposite sides of Jesse Allen Road in the Allentown community with bullets in their heads.

The State Attorney’s Office is seeking the death penalty. Testimony was given Tuesday and Wednesday.

If Hobart is found guilty of first-degree murder, the trial will proceed to the penalty phase. There, the jury would hear evidence on whether to recommend a life sentence or death.

If convicted, Hobart’s fate would ultimately be in the hands of Circuit Judge David Rimmer.

Man Guilty in Fatal Drug Robbery

A Florida Panhandle man has been convicted in a fatal drug robbery.

A Santa Rosa County jury found 43 year old Robert Hobart guilty Thursday of two counts of first-degree murder. The Pensacola News-Journal reports that jurors will reconvene next week to recommend life in prison or the death penalty.

Authorities say Hobart shot 41 year old Robert Hamm and 43 year old Tracie Tolbert in the head and left their bodies by the side of a rural road. Prosecutors say Hobart killed the couple to steal their Roxicodone, which is a prescription painkiller.

Closing arguments to begin in Hobart penalty phase

Closing arguments in the final portion of a trial of a Milton man convicted of murdering an engaged couple will take place this afternoon in a Santa Rosa County courtroom.

Robert Hobart was found guilty last week of murdering Robert Hamm and Tracie Tolbert and leaving their bodies on opposite sides of Jesse Allen Road in the Allentown community.

The State Attorney's Office is seeking the death penalty.

Closing arguments will begin this afternoon for the penalty phase, where the prosecutor and defense attorney will argue to the jury on whether they should recommend life in prison for the death penalty for Hobart. Evidence was presented for both sides during the past two days.

The jury is expected to begin deliberations this afternoon.

Ultimately, however, Hobart's sentence is up to Circuit Judge David Rimmer.

Jury recommends death in Hobart trial

After nearly 100 minutes of deliberations, a jury recommended 7 to 5 today that Robert Hobart receive the death penalty in the murder of Tracie Tolbert, but scaled back to recommend a life sentence in the killing of Robert Hamm.

Hobart was found guilty last week of murdering Hamm and Tolbert and leaving their bodies on opposite sides of Jesse Allen Road in the Allentown community..

The State Attorney's Office is seeking the death penalty.

Ultimately, however, Hobart's sentence is up to Circuit Judge David Rimmer.

Hobart is scheduled to appear in court again early next month for the case.

During her closing arguments, defense attorney Michelle Hendrix detailed Hobart's upbringing, which was rife with dysfunction and abuse.

His life was further complicated by drug addiction, Hendrix said, and his brain was damaged by years of drug abuse.

She also told the jury that if they recommend life, Hobart will die in prison.

Assistant State Attorney Bridgette Jensen mentioned all these issues in her closings, but also reiterated the murders that Hobart was convicted of last week. Those crimes, presented as aggravating factors, far outweigh any reasons the defense presented to spare his life, Jensen said.

Jensen also reminded jurors that only a majority of them need to vote for death to reach their recommendation.
