U.S. court upholds death sentence for 1996 Carlisle murder

The death sentence imposed on a man who shot his ex-girlfriend in the head and then killed her new boyfriend in with a blaze of gunfire in a Carlisle apartment has been upheld by the U.S. Third Circuit Court of Appeals.

The court's decision, issued this week, marks the latest in a string of legal defeats for Antyane Robinson, now 45, formerly of Fort Washington, Maryland.

Robinson was sentenced to death for the June 1996 slaying of Rashawn Bass, 22, of Susquehanna Township. Investigators said Robinson shot and wounded his ex, Tara Hodge, in her home, then shot Bass seven times in the bathroom of Hodge's apartment.

Hodge survived and identified Robinson as the killer. He was convicted of first-degree murder and other charges by a Cumberland County jury in 1997.

Several death warrants have been signed for Robinson, who has filed multiple appeals in the 17 years that have elapsed since his conviction.

I believe Hubert Michael's case was at the 3rd in a different posture. I would have to read the Robinson opinion to see if it was direct from the district court on the first petition.

The panel was unanimous and consisted of judges appointed by Presidents Obama, G.W. Bush and Johnson. Yes, that's right, Senior Circuit Judge Ruggero J. Aldisert was born in 1919 and appointed by LBJ in 1968. According to Wikipedia, he served in the US Marine Corps from 1942 to 1946 and was discharged with the rank of major.

And a fourth, Seifullah Abdul-Salaam, who didn't receive a certificate of appealability from the district court.
