    Governor signs death warrant for Brentt Sherwood

    HARRISBURG — Gov. Edward G. Rendell has signed an execution warrant for Brentt Michael Sherwood, 31, for the murder of his 4-year-old stepdaughter in Dec. 2004.

    Sherwood, currently being held at the State Corrrectional Institution at Greene, is now scheduled to be executed on Sept. 16.

    The jury of 10 men and two women deliberated for 80 minutes in May, 2007 before announcing guilty verdicts for first-degree murder, aggravated assault and recklessly endangering the welfare of children.

    The jury will reconvened the next day and agreed that the death penalty should be imposed.

    Sherwood admitted at trial that he punched and kicked Marlee Rose Reed repeatedly at their residence in Northumberland on Dec. 7, 2004, causing her death the following day.

    However, he pleaded a diminished capacity due to voluntary intoxication, claiming he was high on cocaine and not mentally able to form an intent to kill.

    Child murderer seeking pen pal from death row

    Brentt M. Sherwood, convicted of one of the most horrifying murders in recent Valley history, is looking for pen pals to help him “through hard times” as he sits on death row.

    Describing himself as a “laid back guy with a good sense of humor” on an international website — German Coalition to Abolish the Death Penalty — the former Northumberland resident provides a photograph and lists among his likes and hobbies as the outdoors, meeting new people and exercising.

    Sherwood, 31, was sentenced to death in May 2007 after a Northumberland County jury convicted him of first-degree murder in the December 2004 beating death of his 4½-year-old stepdaughter, Marlee Reed.

    During the trial, Sherwood admitted punching and kicking the child repeatedly in their Northumberland home, but claimed he was high on cocaine and did not mean to kill her.

    Following Marlee’s death, her paternal grandparents, Melvin and Donna Reed, of Lewisburg, established the annual Marlee Reed Memorial Ride held the first Sunday in May to raise awareness about child abuse.

    Reached by phone Thursday, Melvin Reed laughed off Sherwood’s search for pen pals as he awaits execution at State Correctional Institution at Greene in Waynesburg.

    “I think it’s a joke that he wants someone to correspond with,” Reed said. “Apparently what he did is getting to him.”

    The death sentence is likely to take years to carry out pending automatic appeals allowed every condemned offender.

    On the anti-death penalty website, Sherwood is among numerous death row prisoners requesting pen pals.

    Several inmates profess their innocence or describe the poor conditions on death row, but Sherwood’s appeal for friends is upbeat.

    “I like to have fun and I’m straight up,” he writes.

    SUNBURY — Convicted killer and death row inmate Brentt M. Sherwood is scheduled to appear in a Post Conviction Relief Act petition hearing Nov. 7 in Northumberland County Court.

    Following a status conference on Wednesday in front of Senior Judge Harold F. Woelfel Jr., defense attorney Edward J Rymsza, of Williamsport said the hearing at 1:15 p.m. in Jury Room 1 will involve Rule 801, which deals with the prior counsel's qualifications for defense in capital cases.

    Attorney William Ross Stoycos, of the state Attorney General's Office, declined comment.

    Sherwood, 39, who was convicted 11 years ago of beating his 4½-year-old stepdaughter to death, did not appear in court on Wednesday.

    Sherwood, seeking relief from a conviction of first degree murder and the imposition of the death penalty, has originally listed 106 different reasons why he should be awarded a new trial, including ineffective counsel, inappropriate or unlawful procedures from the late Judge William Harvey Wiest, procedural deficiencies and errors or omission of record, according to a 342-page Post Conviction Relief Act motion that was originally filed in 2012.

    Sherwood, a former Northumberland resident, was sentenced to death in May 2007 after a Northumberland County jury convicted him of first-degree murder in the December 2004 beating death of his 4½-year-old stepdaughter, Marlee Reed. During the trial, Sherwood admitted punching and kicking the child repeatedly in their Northumberland home, but claimed he was high on cocaine and did not mean to kill her.

    Sherwood, currently incarcerated at State Correctional Institute-Greene in Waynesburg, is one of 147 inmates — all men — currently on death row in Pennsylvania, and one of three from Northumberland County. The other two Northumberland County inmates on death row are Kevin Marinelli, convicted in the 1994 torture death of Kulpmont resident Conrad Dumchock; and James Frey, of Milton, who pleaded guilty to the January 2004 kidnapping and fatal shooting of his estranged wife, Debra, of Sunbury

    On Feb. 13, 2015, Pennsylvania Gov. Tom Wolf announced a halt to all executions. He said the moratorium will continue until he has "received and reviewed the forthcoming report of the Pennsylvania Task Force and Advisory Commission on Capital Punishment, established under Senate Resolution 6 of 2011, and there is an opportunity to address all concerns satisfactorily."

    The state has only executed three people since the U.S. Supreme Court restored the death penalty in 1976, the last one in 1999. All were executed by lethal injection, and in all three cases, they waived their appeals and asked that the execution be carried out.

    The first was Keith Zettlemoyer, 39, formerly of Shamokin Dam, put to death in 1995, 14 years after he shot and killed former Sunbury newsman Charles DeVetsco, 30. The last was Gary Heidnik on July 6, 1999. Heidnik had been convicted and given two death sentences in July 1988 for murdering two women he imprisoned in his Philadelphia home.

    SUNBURY — Convicted killer Brentt M. Sherwood is off death row but will remain imprisoned for life.

    Following a two-day evidentiary hearing in Northumberland County Court this week, Senior Judge Harold Woelfel Jr. ordered that Sherwood's sentence of death from July 30, 2007, be vacated. Sherwood remains imprisoned without the possibility of parole based on the first-degree murder conviction and agreement of the defense and Commonwealth. Sherwood also agreed to withdraw all Post Conviction Relief Act (PCRA) claims related to the penalty phase of his trial.

    "The court finds that the defendant has made a knowing, intelligent and voluntary waivers of his right to file and litigate post-sentence motions, and has made a knowing, intelligent and voluntary waiver of his right to seek review in the Pennsylvania Appellate Courts, as well as in the federal courts of the newly imposed sentences resulting from the agreement between the Commonwealth and the defendant, including the issue pertaining to the penalty phase relief contained in the defendant's second amended PCRA Petition and his supplemental seconded amended PCRA petition."

    The court finds that the PCRA claims related to the guilt phase of the defendant's trial remain contested by the Commonwealth and the parties will proceed with an evidentiary hearing related solely to the guilt phase claims.

    Sherwood, 42, was convicted 14 years ago of beating his 4 1/2 -year-old stepdaughter to death. Sherwood, a former Northumberland resident, was sentenced to death in 2007 after a Northumberland County jury convicted him of first-degree murder in the December 2004 beating death of 4 1/2 -year-old stepdaughter, Marlee Reed. During the trial, Sherwood admitted punching and kicking the child repeatedly in their Northumberland home but claimed he was high on cocaine and did not mean to kill her.

    Woelfel also imposed a sentence of 3 1/2 years to seven in state prison for the conviction of endangering the welfare of a child and the conviction of aggravated assault merges with the first-degree murder conviction, according to court documents.

    Sherwood had originally listed 106 different reasons why he should be awarded a new trial, including ineffective counsel, inappropriate or unlawful procedures from the late Judge William Harvey Wiest, procedural deficiencies and errors or omission of record, according to a 342-page Post Conviction Relief Act motion that was originally filed in 2012.

    Sherwood, currently incarcerated at State Correctional Institution-Phoenix in Skippack Township, Montgomery County, was one of 112 inmates — all male — currently on death row in Pennsylvania, according to the state Department of Corrections.

    Pennsylvania is one of 27 remaining death penalty states; three more states have abolished capital punishment in the last two years, according to The Associated Press.

    Governor Tom Wolf in 2015 issued a moratorium on executions, citing concerns about innocence, racial bias, and the death penalty's effects on victims' families. The moratorium expires when Wolf leaves office in 2023, according to the AP. Pennsylvania's last execution was in 1999.

    Sherwood was represented by defense attorney Edward J. Rymsza. The Commonwealth was represented by attorney William Ross Stoycos, a senior deputy through the state Attorney General's office.

    The defense has 60 days to file the first briefs concerning the remaining claims of the PCRA, according to court documents.
