    Jose Trinidad Loza - Ohio Death Row




    Facts of the Crime:

    On January 16, 1991, Loza murdered his girlfriend's mother, 46-year-old Georgia Davis, his girlfriend's brother, 25-year-old Gary Mullins, and his girlfriend's sisters, 20-year-old Cheryl Senteno and 17-year-old Jerri Luanna Jackson, who was six months pregnant at the time, in their Middletown home. Ms. Davis had threatened to have Loza arrested if he tried to leave Ohio with her daughter (his girlfriend), who was a minor. Loza shot each of the victims in the head at close range while they slept in the house. Loza confessed to police and told them the order in which he had shot the victims.

    On May 3, 2011, Loza filed an appeal before the US Sixth Circuit Court of Appeals over the denial of his habeas petition in Federal District Court.

    Convictions upheld in Ohio death penalty case

    CINCINNATI (AP) — A federal appeals court has upheld the convictions of a man found guilty of killing four members of his girlfriend's family and sentenced to death in three of the southwestern Ohio slayings.

    A 6th U.S. Circuit Court of Appeals panel today affirmed a U.S. district court's ruling that upheld the aggravated murder convictions of Jose Trinidad Loza. Loza was convicted in the 1991 fatal shootings of girlfriend Dorothy Jackson's family.

    The victims were Jackson's mother, Georgia Davis; brother Gary Mullins; and sisters Cheryl Senteno and pregnant Jerri Luanna Jackson.

    Loza's attorney, Laurence Komp, says they likely will appeal to the full appeals court and the U.S. Supreme Court.

    Loza argued among other things that the trial court improperly allowed statements Loza alleges were made amid police coercion.

    Do you know if Loza has any other options? I'm not sure what "en banc" means. Could you provide some clarification?

    He's still waiting to see whether the US Supreme Court will hear his appeal. Now, as far as "en banc" is concerned:

    Prosecutors have asked the Ohio Supreme Court to set an execution date for a man convicted of killing four members of his girlfriend's family and sentenced to death in three of the slayings.

    The officials from southwest Ohio's Butler County said in a court filing earlier this month that Jose Trinidad Loza has run out of state and federal appeals and should be put to death.

    The 43-year-old Loza was convicted in the 1991 fatal shootings of girlfriend Dorothy Jackson's family.

    The victims were Jackson's mother, Georgia Davis; brother, Gary Mullins; and sisters Cheryl Senteno and Jerri Luanna Jackson, who was pregnant.

    Loza's attorney is expected to oppose the request and has argued among other things that the trial court improperly allowed statements Loza alleges were made amid police coercion.

    Mexico opposes prosecutor's request for man's execution date

    The government of Mexico is opposing an Ohio prosecutor's request to set an execution date for a man convicted of killing four members of his girlfriend's family and sentenced to death in three of the 1991 slayings.

    Mexico says Jose Trinidad Loza was never allowed to consult with a Mexican consulate and was the subject of bias early on, including a crime scene detective who used an ethnic slur to describe him.

    The Mexican government's court filing Monday also says seeking to put Loza to death will aggravate already tense relations between the two countries over the issue of executing Mexican nationals.

    The prosecutor of Butler County in southwest Ohio says the 43-year-old Loza has run out of state and federal appeals and should be executed.

    I grew up with Luanna and Gary. Some of my best memories include them. Luanna was beautiful, kind hearted, and was so much fun to hang out with. Everyone who met her, loved her. Gary was full of life and could always make you laugh. Loza has no regard for human life and deserves what's coming to him. This family was wiped out in a single night due to evil selfishness by this individual. Truly tragic
