    James Dennis Ford - Florida Death Row

    Summary of Offense:

    James Ford and Greg Malnory were co-workers at the South Florida Sod Farm in rural Charlotte County. Ford made plans to go fishing on the sod farm with Greg and his wife Kim on April 6, 1997. On April 7, 1997, the bodies of Greg and Kim Malnory were found in a field near a pond at the sod farm. The 22-month-old daughter of the Malnorys was found alive, but exposed to the elements, in the Malnorys' truck. The medical examiner testified that Greg Malnory had been shot in the back of the head with a bullet from a .22 caliber rifle, bludgeoned at least seven times with an axe, and then had his throat slit. Kim Malnory was raped, and then bludgeoned with an axe nine times in the head by Ford, who then put the barrel of the .22 caliber rifle in her mouth and pulled the trigger. Ford was linked to the crimes by being seen on the same day of the murder with blood on his face, hands, and clothes. Also, a significant amount of DNA evidence, mostly from the sexual offenses, was found at the crime scene and matched Ford’s DNA. Additionally, the .22 caliber rifle used in the murders belonged to Ford.

    Ford was sentenced to death in Charlotte County on June 3, 1999.

    Case Information:

    On 07/01/99, Ford filed a Direct Appeal with the Florida Supreme Court, citing the following errors: improper prosecution comments during the closing arguments of the guilt and penalty phases of trial; the correctness of charging Ford with Child Abuse; insufficient evidence to support the finding of the cold, calculated, and premeditated murder aggravating circumstance; and failure to consider all mitigating evidence. The FSC affirmed the convictions and sentences on 09/13/01.

    On 03/13/02, Ford filed a Petition for Writ of Certiorari with the U.S. Supreme Court, which was denied on 05/28/02.

    On 05/28/03, Ford filed a 3.851 Motion with the Circuit Court. On 05/12/04, an Evidentiary Hearing was held and, on 07/12/04, the Circuit Court denied the motion.

    On 08/16/04, Ford filed a 3.851 Motion Appeal with the Florida Supreme Court and, on 04/12/07, the FSC affirmed the denial of the motion.

    On 06/11/07, Ford filed a Petition for Writ of Habeas Corpus with the United States District Court, which was dismissed on 09/17/09. On 09/22/09, Ford filed a Petition for Writ of Habeas Corpus Appeal with the U.S. Court of Appeals, Eleventh Circuit. On 10/30/09, the U.S. Court of Appeals, Eleventh Circuit, denied the Certificate of Appealability.

    On 11/04/09, Ford filed a Petition for Writ of Certiorari with the U.S. Supreme Court, which was granted on 06/21/10. The judgment was vacated and case remanded for further consideration in light of Holland v. Florida.

    On January 13, 2012, Ford's habeas petition was denied on remand to the Federal District Court.

    In today's orders, the United States Supreme Court declined to review Ford's petition for certiorari.

    Justices reject another batch of death penalty appeals

    TALLAHASSEE, Fla. - For the second day in a row, the Florida Supreme Court on Tuesday turned down appeals by 10 inmates who have been on Death Row since at least 2002.

    The release of 20 death-penalty rulings over two days is highly unusual, with every rejection stemming from legal issues about jury unanimity.

    The appeals were rooted in a 2016 U.S. Supreme Court ruling in a case known as Hurst v. Florida and a subsequent Florida Supreme Court decision.

    The 2016 U.S. Supreme Court ruling found Florida's death-penalty sentencing system was unconstitutional because it gave too much authority to judges, instead of juries. The subsequent Florida Supreme Court ruling said juries must unanimously agree on critical findings before judges can impose death sentences and must unanimously recommend the death penalty. But the Florida Supreme Court made the new sentencing requirements apply to cases since June 2002. That is when the U.S. Supreme Court issued a ruling known as Ring v. Arizona that was a premise for striking down Florida's death-penalty sentencing system in 2016.

    In each of the cases Monday, the Death Row inmates had been sentenced to death before the Ring decision and argued that the new sentencing requirements should also apply to their cases.

    One of the rulings Tuesday dealt with the Charlotte County case of James D. Ford, whose two death sentences became final on May 28, 2002, less than a month before the June 24, 2002, Ring decision, according to the Florida Supreme Court ruling.

    The other inmates who lost their appeals Tuesday were Jeffrey Lee Atwater in a Pinellas County case; Curtis W. Beasley in a Polk County case; Daniel Burns Jr. in a Manatee County case; Ronald Wayne Clark Jr. in a Duval County case; Loran Cole in a Marion County case; Carl Puiatti in a Pasco County case; Richard Wallace Rhodes in a Pinellas County case; Chadwick Willacy in a Brevard County case; and Curtis Windom in an Orange County case.

    Looks like he probably killed his cousin and her 8-month-old daughter in 1994. He was the last person seen with her, and he failed a polygraph.
