    Facts of the Crime:

    In December 1990, Brandon Snider, while visiting his relatives in Indiana, vandalized the bedroom of a former girlfriend, Toni Acker. On January 10, 1991, Patrick Hannon, Ron Richardson, and Jim Acker (Toni Acker’s brother) went to the apartment of Brandon Snider and roommate Robert Carter. When Snider came to the door, Jim Acker stabbed Snider multiple times and Hannon cut Snider’s throat. When Robert Carter came downstairs to investigate, he witnessed the murder and fled upstairs, hiding under his bed. Hannon and Acker followed Carter upstairs and Hannon shot Carter six times.

    Hannon was sentenced to death in Hillsborough County on August 5, 1991.

    Co-defendant information:
    Ron Richardson pled guilty to being an accessory after the fact and testified against Hannon.
    Jim Acker, in a separate proceeding, was convicted and sentenced to two life sentences.

    Fla. death row inmate loses appeal

    ATLANTA (AP) — The federal appeals court in Atlanta has declined to overturn lower court decisions against a new sentencing hearing for Patrick Charles Hannon, condemned for cutting one man's throat and fatally shooting another in Tampa, Fla., 18 years ago.

    Hannon claimed ineffective assistance of trial counsel, saying his lawyer failed to present mitigating evidence during the penalty phase. The defense strategy was to concentrate on Hannon's claim that he was not present at the scene of the Jan. 10, 1991 killings of Brandon Snider and his roommate, Robert Carter.

    Thursday's opinion by a three-judge panel of the 11th U.S. Circuit Court of Appeals said Hannon had failed to show ineffective assistance of counsel and denied his habeas corpus petition.

    Factors Contributing to the Delay in Imposition of Sentence:

    The Direct Appeal process took three years to complete (09/27/91 – 10/10/94) and the 3.850 motion was pending from 03/20/97 – 02/04/03.

    Case Information:

    On 09/27/91, Hannon filed a Direct Appeal with the Florida Supreme Court, citing the following errors: striking two jurors for cause; admitting statements by a prosecution witness; admitting victim forensic evidence and testimony; improper jury instruction regarding the heinous, atrocious, and cruel (HAC) aggravating circumstance; insufficient evidence to support a finding of the HAC aggravating circumstance; the HAC factor is vague, arbitrarily applied, and does not narrow the class of persons eligible for the death penalty; insufficient evidence to support a finding of the avoiding or preventing a lawful arrest aggravating circumstance; disproportionate sentencing compared to accomplices; evidence does not support the prior violent felony aggravating circumstance; and the sentencing order was insufficient. The FSC affirmed the conviction and sentence on 06/02/94.

    On 12/07/94, Hannon filed a Petition for Writ of Certiorari with the U.S. Supreme Court that was denied on 02/21/95.

    On 03/20/97, Hannon filed a 3.850 Motion with the Circuit Court and amended on 04/10/00. The Circuit Court denied the Motion on 02/04/03.

    On 05/09/03, Hannon filed a 3.850 Motion Appeal with the Florida Supreme Court, raising the following issues: ineffective assistance of counsel at the guilt and penalty phases and summary denial of claims by the Circuit Court. On 08/31/06, the FSC affirmed the denial of the motion.

    On 08/23/04, Hannon filed a Petition for Writ of Habeas Corpus with the Florida Supreme Court, raising the issue of ineffective assistance of counsel. On 08/31/06, the FSC denied the petition.

    Hannon filed a Petition for Writ of Habeas Corpus with the U.S. District Court, Middle District on 11/24/06 and amended the petition on 12/20/06.

    On 11/24/06, Hannon filed a Writ of Habeas Corpus in the United States District, Middle Court, and amended this petition on 12/02/06. This motion was denied on 10/23/07.

    Hannon filed a Habeas Appeal in the United States Court of Appeals on 01/08/08. This appeal was denied on 05/27/09.

    Hannon filed a Petition for Writ of Certiorari with the U.S. Supreme Court on 08/11/09. This petition was denied on 11/02/09.

    On 11/29/10, Hannon filed a 3.850 Motion with the Circuit Court. This motion was denied on 03/23/11

    WEST PALM BEACH, Fla. (CBS12) — Gov. Rick Scott signed a death warrant Friday for convicted killer Patrick C. Hannon, setting his execution date for Wednesday, Nov. 8.

    This new death warrant comes just one day after the execution of convicted killer Michael Lambrix.

    If carried out, Hannon will become the 26th inmate in executed during Scott's term.

    Hannon was sentenced to death for the 1991 murders of Brandon Snider and Robert Carter.

    On January 10, 1991, Hannon and two codefendants went to the victims’ residence, according to the state. Hannon knocked on the door while one codefendant hid to avoid being seen. When Snider answered the door, the codefendant attacked him with a knife, repeatedly stabbing him in the chest and abdomen.

    As the victim screamed for his roommate to call 911, Hannon took the knife from his codefendant and sliced Snider’s throat, the state said. The roommate, Carter, came down the stairs of the residence, but upon seeing the situation, fled back upstairs and attempted to hide under his bed.

    Hannon chased Carter into his bedroom, where Hannon fatally shot him six times at close range.

    Hannon will be the third inmate executed since the state resumed executions in August.

    His execution is slated for 6 p.m.

    State Supreme Court Rejects Stay Of November Execution

    With no explanation, the Florida Supreme Court on Tuesday rejected a request to stay the scheduled Nov. 8 execution of Patrick C. Hannon, who was sentenced to death in the 1991 murders of two men in Hillsborough County.

    The court issued a unanimous ruling, with Justice Peggy Quince recused, to deny a motion for a stay filed last week by Hannon's attorneys.

    The motion was rooted in a 2016 U.S. Supreme Court ruling that found Florida's death-penalty sentencing system was unconstitutional because it gave too much authority to judges, instead of juries.

    A subsequent Florida Supreme Court ruling said juries must unanimously agree on critical findings before judges can impose death sentences and must unanimously recommend the death penalty. The Florida Supreme Court applied those standards to death sentences dating back to 2002. But Hannon's attorneys argued that the standards should be applied to earlier cases.

    While a jury unanimously recommended that Hannon receive the death penalty, his attorneys contended there was no evidence that the jury was unanimous on the findings of fact.

    “The jury did not find unanimously and expressly all the aggravating factors were proven beyond a reasonable doubt, unanimously find that the aggravators were sufficient to impose death, unanimously find that the aggravators outweighed the mitigators,” Hannon's attorneys said in a document filed last week.

    Hannon was sentenced to death in the murders of Brandon Snider and Robert Carter. Hannon and two other men went to the apartment where Snider and Carter lived on Jan. 10, 1991. After one of the other men attacked and stabbed Snider, Hannon was accused of cutting Snider's throat, according to a court document. Hannon was then accused of fatally shooting Carter, who had tried to hide under a bed.

    Gov. Rick Scott signed a death warrant Oct. 6 and scheduled Hannon's execution for Nov. 8.

    Florida Supreme Court rejects plea to stop pending execution

    TALLAHASSEE, Fla. (AP) — The Florida Supreme Court is refusing to block the pending execution of a man convicted of killing two people.

    The court ruled Wednesday against Patrick Hannon, who is scheduled to die Nov. 8.

    Authorities say Hannon and two other men went to the Tampa apartment of 27-year-old Brandon Snider and 28-year-old Robert Carter in January 1991. One of the other men stabbed Snider several times when he answered the door, and then Hannon cut Snider’s throat.

    Carter also lived in the apartment. He tried to hide, but Hannon followed and fatally shot him.

    Hannon’s attorneys argued that his execution should be stopped for several reasons. The court rejected those arguments.

    Justice Barbara Pariente dissented from Wednesday’s ruling and said the jury was not properly presented with information about Hannon’s background before recommending a death sentence.

    Patrick Charles Hannon has lived two lifetimes: The 26 years he lived before he was sent to Death Row, and the 26 years he has spent on it.

    He and two other men brutally murdered roommates Brandon Snider, 27, and Robert Carter, 28, in a townhouse near the University of South Florida on Jan. 10, 1991.

    Hannon was 26 then, and a jury unanimously voted that he should die.

    Now he is 53, and set to be executed on Wednesday. Gov. Rick Scott signed his death warrant last month.
    For Snider’s half brother, Hannon’s death would be justice served.

    "I think it should have happened a long time ago," said Tony Snider. "He’s had 26 years more than my brother had."

    But he knows Hannon’s execution will only ease so much.

    "I’ll just feel like there’s closure," said Tony Snider, who shared a father with Brandon Snider. "I know there’s no way it’s going to bring my brother back."

    Tony Snider said his younger half brother started life "with two strikes against him." He was born to an alcoholic mother and suffered the symptoms of fetal alcohol syndrome. And after birth, his mother abandoned him.
    Investigators believe he was the target in 1991. Prior to the killing, they said Brandon Snider had returned to Indiana and threatened his ex-girlfriend, Toni Acker, the sister of co-conspirator James Acker, and reportedly fired a gun into her home and left a threatening note.

    Tony Snider remembers it differently. He said Toni Acker had agreed to celebrate Brandon Snider’s birthday with him, but instead he discovered that she was out with another guy. Tony Snider said his half brother caused damage to her bedroom.

    That was during the Christmas holiday, Tony Snider said. On his way back to Tampa, during a layover in Atlanta, he said Brandon Snider called his ex-girlfriend, apologized and offered to pay for the damages.

    "So everything was alright as far as I knew, as far as he knew," Tony Snider said.

    Investigators believed Acker, Hannon and Ronald Ivan Richardson went to the Cambridge Woods Apartments near USF looking for Snider.

    Snider was the first to die. Acker stabbed him 14 times and Hannon then slit his throat "to the point of near decapitation," according to court records.
    Carter begged to be let out of the apartment, investigators said, but the men chased him upstairs. He tried to hide in a bedroom, but Hannon shot him six times in the chest.
    Richardson cut a deal with prosecutors, accepting a charge of accessory after the fact and a five-year prison sentence in exchange for testifying against the other two.

    Acker, now 53, is serving his sentence at Cross City Correctional Institution in Dixie County. He was convicted in both murders and sentenced to serve two life sentences before winning a new trial. He was convicted again in 2001 and sentenced to life in prison, plus 22 years.

    Tony Snider said he has no reservations about Hannon’s fate.

    "A tooth for a tooth, an eye for an eye," he said. "He took my brother’s life, why shouldn’t the state of Florida take his?"

    The execution is scheduled to take place Wednesday at 6 p.m. at Florida State Prison in Raiford.

    I wonder if they mantain the mocking smile they had in their prison mugshot when remains one day, or one hour to live, or if they piss in their pants with a beaten dog face.
