    Cedric Carter - Ohio Execution - August 27, 2025




    Summary of Offense:

    On April 6, 1992, Carter murdered 56-year-old Frances Messinger at a United Dairy Farmers convenience store (UDF) in Cincinnati. Ms. Messinger was working alone as a clerk at the UDF on the night she was murdered. Carter and his accomplice, Kenny Hill, entered the store while accomplice, Virgil Sims, waited outside in the "getaway car." While robbing the UDF, Carter shot Ms. Messinger once in the forehead. After Hill surrendered himself, Carter confessed to the police.

    In today's Sixth Circuit Court of Appeals opinions, the court AFFIRMED the district court's denial of Carter's habeas petition, but granted COA on two claims of ineffective assistance of counsel, and whether the state courts improperly used the “nature and circumstances” of the offense as aggravating, rather than mitigating, factors. The case has been remanded to the district court for further consideration.

    On July 31, 2013, Carter was granted a Certificate of Appealability in US District Court.

    On April 20, 2016, oral argument will be heard in Carter's appeal before the Sixth Circuit. The panel will be made up of Judges Cole (Clinton), Clay (Clinton) and Sutton (G.W. Bush).

    Execution date set for Cleveland man convicted of 1985 murder over sewing machine theft

    CLEVELAND, Ohio -- The Ohio Supreme Court on Friday set the execution date for a Cleveland man convicted of murder in 1985 for murdering a man in a spat over a sewing machine

    Percy "June" Hutton, convicted of killing Derek "Ricky" Mitchell and attempting to murder Samuel Simmons Jr., will be put to death on June 22, 2022.

    Hutton, 63, shot Mitchell and Simmons after luring the two men into his car. He had accused the two men of stealing the sewing machine, which had $750 hidden in it.

    A judge sentenced him to death in 1986.

    The state has set execution dates for Hutton multiple times, but all have been pushed back as he continues to challenge his case in court.

    Most recently, a federal appeals court overturned his death sentence in 2016, citing faulty jury instructions. The U.S. Supreme Court reinstated Hutton's death sentence in June.

    The state's high court on Friday also set an execution date of Aug. 24, 2022 for Cedric Carter, who murdered United Dairy Farmers convenience store clerk Frances Messinger during a robbery in 1992.

    Ohio resumed executing death-row inmates in July, following a two-and-a-half year reprieve. Gary Otte, a man who killed two in Parma in 1992, was executed Sept. 13.

    This is 2017. These offenders (Percy Hutton and Cedric Carter) have had their executions set for 2022.

    Does it make any sense to schedule executions five years in the future? The world could be in the clutches of a zombie apocalypse by then.

    Or am I missing something here?
