    Summary of Offense:

    On April 13, 2005, Dean and his 16-year-old accomplice Joshua Wade robbed and murdered a 30-year-old youth counselor, Titus Arnold, in Springfield. The murder of Titus was the third incident in a four-day shooting spree in Springfield where Dean attempted to kill six other people. Dean ordered Titus to get on the ground as he walked home from work and when Titus began to run Dean attempted to shoot him with a .25 caliber semi-automatic, but the gun was on safety. Wade killed Titus with .40 caliber semi-automatic. Dean recruited Wade to engage in the robbery and murder of Titus by supplying the vehicle, fire arm, and ammunition for the crime. Dean later bragged to his friend and girlfriend about the murder. Wade received life imprisonment for his involvement in the murder.

    Convicted killer waive appeals, comes closer to execution

    Jason Dean, convicted in 2006 in the murder of an area youth counselor, came one step closer to execution Thursday, Feb. 26, after a judge granted Dean's motion to abandon part of his appeal process.

    Clark County Common Pleas Judge Douglas Rastatter granted Dean's motion to dismiss all his post-conviction proceedings in the local court, said Clark County Prosecutor Stephen Schumaker.

    Dean will continue an appeal pending in the Ohio Supreme Court, said his attorney, Joseph Wilhelm, assistant state public defender.

    A defiant Dean mocked the court, calling Rastatter "vindictive," and said he wanted to drop his appeals so the judge would have nothing more to do with his case.

    "You're not going to do anything to benefit me, you sentenced me to death," said Dean.

    Dean was convicted of the 2005 killing of Titus Arnold.

    Prior to the ruling, Wilhelm asked the court to delay its decision so his client's competency could be evaluated, citing Dean's "lack of emotional stability."

    Vickie Arnold, Titus Arnold's mother, said she was upset with what Dean said to the judge.

    "I feel the court was more than fair with Jason," she said. "(Dean) put himself on death row."

    Dean told the court he wasn't afraid to die.

    "Eventually I will be executed, I have no fear of that," said Dean. "Let the wheels of justice turn."

    Schumaker called Dean's behavior an example of the "numerous antics" that officials have witnessed in prior hearings.

    "It seems to be a continuation of what we've come to expect from (Dean)," said Schumaker.

    Dean's appeal is not yet scheduled for oral argument in the supreme court, said Wilhelm.

    An execution date will be set depending on the outcome of that proceeding.

    Clark County trial judge was biased, ruling says


    The Ohio Supreme Court has thrown out the death sentence of a man convicted of killing a youth counselor, saying the judge failed to provide a fair trial.

    The court's decision today also ordered a new trial for defendant Jason Dean even as the justices acknowledged substantial evidence of his guilt.

    The unanimous ruling said Judge Douglas Rastatter of Clark County Common Pleas Court was so biased against Dean's attorneys that he tainted the entire trial.

    The decision said relations between the judge and lawyers broke down after the defense tried to have Rastatter removed for alleged bias against Dean.

    Dean was convicted in 2006 of killing the counselor during a four-day shooting spree in Springfield.

    A message left for Rastatter today was not immediately returned.

    Judge recuses self in Jason Dean murder retrial

    Clark County Common Pleas Judge Douglas Rastatter has recused himself from a capital murder case that was ordered retried by The Ohio Supreme Court earlier this year.

    Jason Dean, 35, was convicted of aggravated murder four years ago in connection with the 2005 robbery and killing of youth counselor Titus Arnold.

    After the penalty phase of Dean’s trial, Rastatter sentenced him to death, following the jury’s recommendation.

    The Supreme Court unanimously overturned that conviction in October, ruling that Rastatter made rulings and statements during the trial that “demonstrated bias against Dean and his attorneys that prevented Dean from receiving a fair trial.”

    In an entry filed Dec. 22, Rastatter wrote that he was recusing himself so that Dean would have a new trial “in the truest sense,” and that the trial “should be presided over by a judge who has not yet rendered an opinion on the appropriate punishment.”

    The case was transferred to Judge Richard O’Neill.

    Arnold died after being shot at High and Race streets April 13, 2005. He walking home from his job at Visions for Youth, a youth counseling service, when he was accosted by Dean and Joshua Wade, then 16.

    Wade was convicted of pulling the trigger in the shooting and was sentenced in adult court to life in prison.

    Arnold was robbed of $6.

    SPRINGFIELD — Prosecutors called witnesses Tuesday in the second capital murder trial of Jason Dean.

    Dean, now 37, is charged with the 2005 murder of youth counselor, Titus Arnold, an armed robbery and a drive-by shooting.

    Jurors were shown pictures of Arnold, 23, after he was shot in the head on his way to his car after work at Visions for Youth on April 13, 2005.

    They also heard from witnesses who say they saw Dean and Joshua Wade, then 16, around High and Race streets before Arnold was killed.

    Former Clark County Prosecutor Stephen Schumaker said during opening statements that Wade shot and killed Arnold, but described Dean as the ring leader of a “crime team” that terrorized Springfield for four days.

    “Titus Arnold was a completely innocent victim,” Schumaker said.

    “(Dean) can’t hide behind the fact that Josh Wade fired those final shots that resulted in the death of Titus Arnold. Because on April 10, on April 12 and April 13, when all those shots were being fired, that man was working as a team with his boy, Josh Wade.”

    Dean faces several charges, including murder, vehicular homicide and aggravated robbery.

    Wade was convicted in adult court for his role in the crimes and sentenced to life in prison.

    Dean was found guilty and sentenced to death in 2006.

    But the Ohio Supreme Court overturned his conviction in 2010, ruling Judge Douglas Rastatter made rulings and statements during the trial that “demonstrated bias against Dean and his attorneys that prevented Dean from receiving a fair trial.”

    Defense attorneys say their client did not kill Arnold and say the only people who can place Dean at the scene are those with reasons to lie.

    The trial will resume today.

    Cheers for the info iMx Does anyone know if the death penalty is being pursued second time round?

    I did a little research and I could not find anything about the death penalty being pursued a second time. I would suspect that it will be though because prosecutors sought it the first time and theres no plea deal here where Dean could plead guilty and receive life in prison.

    Dean found guilty in 2005 murder of youth counselor

    Jason Dean winked and blew kisses at family and friends Thursday as he was found guilty of killing a youth counselor and the attempted murder of a pregnant woman and a child.

    Dean, 37, was found guilty of aggravated murder for his role in the 2005 death of Titus Arnold, a youth counselor who was shot in the head and robbed of $6. He was also convicted of 13 other charges including six counts of attempted murder in which a 1-year-old and a pregnant Shanta Chilton were “centimeters close” to being shot, according to witnesses.

    The jury of eight women and four men returned the convictions in Clark County Common Pleas Court on Thursday afternoon after deliberating since Tuesday.

    The capital murder trial now moves to the penalty phase. Jurors will hear arguments on Monday. Because of the aggravated murder charges, Dean is eligible for the death penalty.

    The charges stem from a four-day crime spree involving Dean and Joshua Wade, then 16, whom prosecutors described as Dean’s “sidekick.”

    The “crime team,” prosecutors said, murdered Arnold and days earlier committed an armed robbery and terrorized Dibert Avenue residents in a drive-by shooting.

    Wade, who fired the shot that killed Arnold and was identified as the gunman in the drive-by shooting, was sentenced to life in prison in 2006 for his role in the crimes.

    That same year, Dean was convicted and sentenced to death.

    The Ohio Supreme Court overturned his conviction in 2010, determining Clark County Judge Douglas Rastatter made rulings and statements during the trial that “demonstrated bias against Dean and his attorneys that prevented Dean from receiving a fair trial.”

    Prosecutors and Dean’s attorney declined to comment about the verdict. Arnold’s family members also declined to comment.

    But Arnold’s mother, Vickie, said in 2010 that Rastatter was more than fair in the first trial.

    “I think he got a fair trial the first time,” Arnold said then. “It isn’t fair to our family to put us through that again.”

    Jury recommends death sentence for Jason Dean

    Willie Arnold said Jason Dean deserves to be put to death for killing his son.

    “When somebody is that foul then that’s what should happen. You destroy that. You don’t let that come back out in the world and cause somebody else harm. Everything in me, if he would ever go free again, I don’t think that would change,” the 57-year-old father said Tuesday.

    He offered his comments after a Clark County Common Pleas jury recommended that a judge sentence Dean to death for his role in a four-day crime spree that ended with the death of Titus Arnold, a youth counselor who also was robbed of $6 as he was leaving work.

    The jury deliberated two days before rendering its verdict.

    Dean took the decision in stride, turning to his family and friends and blowing a kiss.

    “That’s all right,” Dean, 37, told them.

    His response was similar to his actions last week when the jury of eight women and four men convicted him on 13 charges that included aggravated murder, attempted murder and aggravated robbery.

    Tuesday, visiting Judge Sumner Walters, a retired jurist from the 3rd District Court of Appeals, also found Dean guilty of three additional counts of possessing weapons as a felon.

    Walters will determine at 1:30 p.m. on Sept. 30 whether to follow the jury’s recommendation or sentence Dean to life in prison.

    Prosecutors said Dean was the ring leader of a “crime team” and manipulated then 16-year-old Joshua Wade into firing the shot that killed Arnold.

    They also told jurors Dean coerced Wade into participating in a drive-by shooting on Dibert Avenue in which several people, including a pregnant woman and a 1-year-old girl, were nearly killed.

    Wade was convicted and sentenced to life in 2006.

    Dean was sentenced to death that same year, but the Ohio Supreme Court overturned the conviction in 2010, determining Clark County Judge Douglas Rastatter made rulings and statements at trial that prevented Dean from from receiving a fair trial.

    Dean’s friend, Cristina Gonzalez, and cousin, Brandy Murphy, hope he does not have to return to death row.

    “He’s not a cold-hearted killer. He’s got a heart and he’s a good person. If they knew the person we know they wouldn’t judge him,” Gonzalez said.

    “I don’t think he deserves death, but he’s never going get a fair shot here because everybody judges him here.”

    Arnold’s family said jurors again made the right decision. His mother, Vickie Arnold, 53, said the second trial forced their family relive their worst nightmare.

    “To have to relive this again was just like burying my (son) all over again,” she said.

    She also said Dean’s actions during the trial and after the verdicts were disrespectful to the Arnold family.

    “He should have come in, in handcuffs and shackles. We don’t have that right to blow kisses at Titus, wink our eye at Titus, and touch Titus. I don’t think he should have that right,” she said of Dean.

    Gonzalez defended Dean. She said his smiles and gestures were signs that he was nervous and were not meant to disrespect the Arnolds.

    She also said she prays for the Arnolds daily and is sorry they lost their son, but noted that Dean’s punishment should not be harsher than Arnold’s killer.

    Willie Arnold disagreed. He called Dean a manipulator.

    “As a father, as a man, this has tried me. Being a father there’s that unwritten rule that we have to protect what’s ours and for me not to be able to protect my son...,” Willie Arnold said sobbing, unable to complete the sentence.

    “It’s been hard,” Vickie Arnold said.
