    James P. Frazier - Ohio




    Summary of Offense:

    On March 2, 2004, Frazier murdered 49-year-old Mary Stevenson at her North Toledo apartment. Frazier, who lived in the same apartment building as the disabled Stevenson, strangled her, slashed her throat, then stole her purse and wallet.

    On May 27, 2009, Frazier filed a habeas petition in Federal District Court.

    On November 16, 2011, Frazier filed an appeal in the US Sixth Circuit Court of Appeals over the denial of his habeas petition in Federal District Court.

    Interestingly, James Frazier was 64 years old when received on Ohio's Death Row in 2005, (he is now 71) according to the Department of Corrections for Ohio's Death Row Roster. I believe he may still hold the record for oldest person sentenced to death (at time of death sentence) in the USA since 1976. I thought for a few months Donald Bess, 64, achieved this record when he was sentenced to death in Texas in 2010, aged 62, for a murder he committed in 1984. Does anyone know of any U.S. death row inmate who was 65 years of age or older when they were sentenced?

    Viva Leroy Nash was 67 or 68 when sentenced.

    Ah yes...of course, Viva Nash died aged 94 in 2010. The current oldest death row inmate in the USA is David Carpenter of California Death Row, 81, the notorious 'Trailside Killer', received aged 58. The next is John Vining, Sr., 81, of Florida death row, received aged 59 in 1990 (Mr. Carpenter was born on 6th May 1930, Mr. Vining was born on 13th March 1931).

    In today's opinions, the Sixth Circuit Court of Appeals AFFIRMED the district court’s denial of Frazier’s petition for a writ habeas corpus contending he is ineligible for the death penalty under Atkins v. Virginia, 536 U.S. 304 (2002), due to his intellectual disability, that his trial counsel provided ineffective assistance, and that Ohio’s lethal-injection regime is unconstitutional.

    On December 18, 2014, the US Court of Appeals for the Sixth Circuit DENIED Frazier's petition for en banc rehearing.
