    Summary of Offense:

    On December 11, 2001, Jackson and his girlfriend, Donna Roberts, murdered Roberts' former husband, 57-year-old Robert Fingerhut, at the home Roberts shared with Mr. Fingerhut in Howland Township. Roberts let Jackson into her home to wait for Mr. Fingerhut. When Mr. Fingerhut returned home from work, Jackson shot him twice in the back and once in the head, then stole his car. DNA testing on bloodstains found in Mr. Fingerhut's car matched the profiles of Jackson and Mr. Fingerhut. Jackson admitted the shooting to police, but claimed it was committed in self-defense. Donna Roberts also received a death sentence for the murder of Robert Fingerhut.

    According to page 187 of this link, Mr Jackson got a new resentencing.

    Does anyone know why he got a resentencing? I've looked around but I'm not finding anything that would indicate a reason.

    Judge gives death penalty to killer again

    WARREN - Trumbull County Common Pleas Judge John M. Stuard was adamant Tuesday about sentencing Nathaniel Jackson to death for the second time.

    Stuard told a courtroom he is retiring in December and insisted that the matter be resolved before then and only by him. The judge sentenced Jackson to be executed on Aug. 5, 2013.

    Jackson, 40, was first sentenced to die by Stuard after a capital murder trial in December 2002 for his role in the Dec. 11, 2001, murder of Robert Fingerhut of Howland. Fingerhut was murdered in his Avalon Drive home after a conspiracy between Jackson, who had recently been released from prison, and Fingerhut's live-in companion, Donna Roberts.

    Roberts was convicted and sentenced to die in 2003.

    The two carried on a brief love affair and planned to cash in on life insurance proceeds after Fingerhut, who operated Greyhound Bus terminals in Warren and Youngstown, was shot to death, according to prosecutors who presented a series of prison love letters that outlined the murder plot.

    An attorney for Jackson had filed three different attempts to have Stuard disqualified from the re-sentencing proceeding. Each one was denied by the Ohio Supreme Court.

    Stuard in the meantime overruled motions in court Tuesday by attorney Randall Porter of the Ohio Public Defender's office asking that a second attorney be appointed for the court appearance and that more mitigation material be admitted for consideration.

    ''We're not broadening the scope here,'' the judge said. ''I see this in a very narrow light.''

    Nor did Stuard agree with Porter's argument that Jackson shouldn't be sentenced again on charges of aggravated robbery and burglary. Porter said those charges shouldn't be considered in a new sentence.

    The 11th District Court of Appeals remanded Jackson's case to Stuard for re-sentencing in October 2010 after Stuard denied a move to re-sentence. The appellate court also vacated Jackson's sentence temporarily, leaving Jackson reassigned from Ohio's death row to Trumbull Correctional Institution.

    Jackson told the judge he has improved himself with life among the normal prison population, developing basic computer skills and skills in music. He said he works as a tutor.

    The appellate court's opinion to re-sentence was based on a written reprimand handed to Stuard in January 2009 when he and an assistant prosecutor were cited by the Ohio Supreme Court for ethical improprieties in a sentencing memorandum in Roberts' capital case.

    Roberts' sentence was vacated for a time and then she was re-sentenced to death, leaving her as the only female in Ohio facing execution.

    The potential professional misconduct came up when the Supreme Court reviewed the trial record of the death row inmate, citing one party discussions over Roberts' death sentence between Stuard and two assistant prosecutors.

    The reprimand basically identified the discussions as the judge deciding on Roberts' sentencing, then requesting a prosecutor draft a document consistent with his opinion. The prosecutor returned the document to the judge, who made revisions and the document was redrafted.

    No, it's in 2013 even if it's a mere administrative date set just to move Jackson's appeals along.

    This cause is pending before the Ohio Supreme Court as a death-penalty appeal from the Court of Common Pleas of Trumbull County.

    Upon consideration of appellant’s motion for stay of execution scheduled for August 15, 2013, it is ordered by the court that the motion is granted pending final disposition of Jackson's direct appeal.
