    Summary of Offense:

    On October 22, 2006, Lang and his accomplice, Antonio Walker murdered local drug dealer, Jaron Burditte and his friend Marnell Cheek. Lang contacted Mr. Burditte by cell phone to set up a drug deal while Lang and Walker planned to rob Mr. Burditte at gunpoint. When Mr. Burditte arrived at the agreed upon location, Lang entered the vehicle alone and almost instantaneously shot Mr. Burditte and Ms. Cheek in the head with a 9mm pistol.

    Ohio Supreme Court hears Stark death-penalty case

    CANTON — The Ohio Supreme Court heard arguments Tuesday morning in the death-penalty case of Edward L. Lang III.

    A Stark County jury convicted Lang in 2007 of killing Jaron N. Burditte and Marnell M. Cheek during a robbery.

    Tuesday was the first time the state’s highest court heard arguments on the appeal.

    According to testimony, Lang and another man, Antonio M. Walker, plotted to rob Burditte during a drug deal on Oct. 22, 2006. Burditte and his girlfriend, Cheek, were each shot in the head while sitting in Burditte’s red Dodge Durango on Sahara Avenue NE.

    Lang, who was 19 at the time of the shooting, was sentenced to die for Cheek’s murder.

    Walker cooperated with prosecutors and was sentenced to 18 years to life in prison.

    In Columbus, Assistant Ohio Public Defender Rachel Troutman made several arguments for why Lang’s conviction and sentence should be overturned.

    One had to do with the fact that a juror seated for the trial was related to one of the victims. The juror was removed from the panel before any deliberations took place.

    Other issues discussed before the court included Lang’s troubled childhood — he grew up in Baltimore and moved to Canton a few months before the shootings — his history of mental-health problems, the proportionality of his sentence versus Walker’s and the weight of the evidence, which Troutman said wasn’t sufficient to support the conviction.

    Assistant Stark County Prosecutor Kathleen Tatarsky argued that Lang’s trial was conducted properly and that his conviction and sentence should be upheld. She also said Lang’s spiteful statement to Burditte’s family after sentencing showed a lack of remorse.

    Troutman acknowledged that Lang’s words were terrible, but argued he had just been told he was going to die and wasn’t on medication at the time.

    COLUMBUS, Ohio (AP) — The Ohio Supreme Court has upheld the death sentence given a Canton man convicted of gunning down two men in a 2006 drug-related killing.

    A jury sentenced Edward Lang to death for the killing of Jaron Burditte and sentenced him to life without the possibility of parole for the killing of Burditte's friend, Marnell Cheek.

    Court records say Lang and an accomplice had contacted Burditte, a local drug dealer, with plans to rob him.

    The court's Wednesday decision overruled objections by Lang that the original indictment did not properly spell out the elements of the death penalty case against him.

    The court set a 2013 execution date for Lang but that will likely be delayed by years of federal appeals.

    On March 6, 2018, oral argument will be heard in Lang's appeal before the Sixth Circuit. The panel will be made up of Senior Judge Siler (G.H.W. Bush) and Judges Moore (Clinton) and Gibbons (G.W. Bush).
