    California Supreme Court upholds death penalty in 1995 double-slaying

    The California Supreme Court upheld on Thursday, Dec. 19 the death penalty for a Moreno Valley man condemned in 2002 for the throat-slash murders of a father and son during a home-invasion robbery.

    Robert Lee Williams Jr., now 46, was convicted in September, 2002 for the 1995 murders of Roscoe Williams, 54, and his 28-year-old son, Gary. The defendant is not related to the victims.

    A Riverside County Superior Court jury also convicted him of the attempted murder of Conya Lofton, who was Gary Williams’ girlfriend. She survived her throat being cut, called 911 while the robbers were distracted, and ran covered in blood and half-naked from the home the night of the slayings.

    Among the issues in the ruling was Robert Lee Williams’ claim that he had been denied a constitutionally-guaranteed speedy trial. Williams was arrested in 1995 but not tried for seven years.

    But after a lengthy review of the case’s pretrial history, the court concluded, “we are able to isolate only a handful of delays for which the prosecution appears directly responsible.” Five justices joined in the 125-page opinion written by Associate Justice Goodwin Liu.

    Associate Justices Marvin R. Baxter and Ming W. Chin concurred with the majority that Williams’ speedy trial claim was without merit, but said they disagreed with the analysis. Robert Lee Williams was sentenced in 2003.

    Prosecutors said Williams and two other men ransacked the Moreno Valley home of Gary Williams, binding the victims with duct tape as they searched for money and jewelry.

    The defendant, wanted a large amount of cash that he believed was hidden at the house. Gary Williams ran a small ring of robbers who hit about 20 banks and credit unions in Southern California during the early 1990s, investigators said.

    Robert Williams had learned about the robberies and in early July confronted Gary Williams, pressed a gun to his head, and demanded a share of the loot, investigators said.

    Five days before the July 15, 1995 home-invasion attack, Gary Williams provided guns and acted as a lookout for two other men who stole $56,000 from an Orange County credit union. The other two men were arrested after a high-speed police chase, but Gary Williams fled in a separate car and escaped.

    Part of the reason for the robbery was to pay Robert Williams money he was demanding from Gary Williams and his crew, the ruling noted.

    On the night of the slayings, Roscoe Williams had dropped by the house to fix the lawn sprinklers, washer, dryer and a microwave for his son and was he was surprised by the intruders. Lofton, who was dating Gary Williams, was upstairs when accosted by Robert Williams, according to trial testimony.

    The victims' throats were slashed, but Lofton survived and escaped to identify the defendant and his cousin, Ronald Walker, who was convicted at a separate trial and sentenced to a no-parole life term. The third man who was inside the home also has never been identified.

    Prosecutors said Robert Lee Williams was the ringleader who used force and psychological terror to coerce Gary Williams into revealing where he had hid the cash in a vacuum cleaner. Robert Lee Williams also sexually taunted and assaulted Lofton, then ordered his cohorts to slit the throat of Gary Williams' father to show he was serious about getting the money.

    In today's United States Supreme Court orders, Williams' petition for writ of certiorari and motion for leave to proceed in forma pauperis was DENIED.
